Bizarre moment at the Michigan Senate debate after Haley Stevens says “the filibuster must go.” She adds that Democrats “should use the filibuster to not allow the big ugly bill to pass that increased our debt.” Pressed on whether she opposes or supports using the filibuster, Stevens says: “We should remove the filibuster so Democrats could have voted down the legislation, the tax bill.” That is not how the filibuster works. Removing it allows all Senate bills to pass at 51 votes. It would not have allowed Democrats to stop Trump’s tax bill, which was already exempt from the filibuster.

Senate Republicans finally got 50 votes for the Save America Act and VP Vance’s vote would make 51! But it can’t pass because Senate Republicans don’t have the courage to override the filibuster and actually pass the election integrity bill that Americans are demanding! The filibuster 60 vote rule is a self imposed rule that they can easily override, but refuse to. The Republican controlled Senate is absolutely spineless and worthless. Democrats will definitely override the filibuster when they gain the majority in the Senate.

🇺🇸 THE MYSTERIOUS FILIBUSTER! - As much as we talk about the filibuster, few people actually understand it. Under filibuster rules you don't need 60 votes to pass legislation. You need 60 votes to get to cloture, which means you can then vote on the legislation. Right now with the SAVE America Act we have 51 votes. We have enough votes to pass the legislation but we can't get to cloture because we can't get enough Democrats to cross the aisle to get to 60 votes. Of course Democrats don't want election integrity. We talk about the nuclear option, thinking that this means the Senate will vote to end the filibuster rule. That's not what it means. Actually achieving cloture to vote to end the filibuster rule would require a two-thirds Senate vote. And that's impossible. What is possible is when you bring up the SAVE America Act for a cloture vote and you only get 51 out of the 60 required, a senator can then raise a point of order saying that "cloture on this bill should only need a simple majority." The chair would rule against him, backed up by the parliamentarian. That senator can then appeal and the question becomes, "shall the decision of the chair stand?" The Senate then votes on that appeal and if 51 senators vote to overrule the chair then the vote on the SAVE America Act can take place. Yes this is a tortured way of doing things but that's "the nuclear option." Harry Reid did it in 2013 on federal judges and Mitch McConnell did it in 2017 on Supreme Court judges. But again the problem we have now is: do we have enough Senators to get to 51 to do the nuclear option? According to John Thune we don't. Thoughts? ⬇️

The Senate has 100 members. Passing a continuing resolution (CR) requires 60 votes to overcome a filibuster. Republicans: 53 Independents (who caucus with Democrats): 2 Total non-Democrat votes available: 53 + 2 = 55 Assuming all 53 Republicans and 2 independents vote yes, and all 43 Democrats vote no, the bill fails unless at least 5 Democrats switch to yes. This is the democrat's shutdown.
