At this point, a second ICE agent is seen, standing on the side of the car, with HIS gun drawn, too. And after all of that… The man, they were demanding papers from, walks away because he wasn’t undocumented. And the ICE agents get into their car and leave. Federal officers are trained to draw their firearms only when they reasonably believe there is an imminent threat of death, or serious bodily harm. Every time a loaded firearm is pointed at someone, there is a risk of a tragic mistake… especially in a public place where innocent bystanders could be caught in the middle. And once again… recording federal agents, from a public place, is protected by the First Amendment, so long as you are not interfering with their duties. And no one was interfering… or even near them. So, what exactly justified having multiple firearms drawn, and pointed at unarmed people, in a crowded gas station parking lot? This wasn’t just dangerous for the people filming… It was dangerous for everyone in that parking lot. And this video is just another example of what happens when poorly trained ICE agents aren’t held accountable.

The agents stop, get out of their cars, and approach THEM. One agent has his GUN drawn, another has his TASER drawn. The agents tell the legal observers to stop following them. A U.S. citizen responds: “We aren’t doing anything illegal. It’s totally legal to follow you.” He is correct. The First Amendment protects the right to record law enforcement, and federal agents, carrying out their duties in public. And federal regulations specifically recognize that people can record publicly accessible federal activity from public sidewalks, and streets, when they aren’t impeding or disrupting operations. Then, the agent says: “Stop following us, you aren’t going to like the outcome.” That is a serious First Amendment retaliation issue. And then it gets even more dangerous. The same armed federal agents, who just threatened these people with weapons and retaliation… surround the citizens’ car and claim THEY are blocking traffic. But look at the video. The only people blocking traffic are the ICE agents… who have now boxed in the citizens’ car. Agents cannot detain someone because they don’t like being watched. A vehicle stop requires reasonable suspicion of an actual legal violation. And recording and observing ICE agents, from a public place, is not obstruction. It is not illegal. Government agents are supposed to be accountable to the people… not the other way around. The First Amendment protects your right to watch and record your government. The Fourth Amendment limits the government’s power to stop and detain you. And neither one comes with an ICE exception.

In Chicago, at least 7 unmarked ICE vehicles, and around a dozen ICE agents, surround a car with two women inside, demanding they prove their citizenship… And then let them go when they proved they were U.S. citizens. So, why were they stopped in the first place? ICE cannot stop people, and demand they prove their citizenship, based on a hunch… or because an agent thinks someone “looks undocumented.” The Fourth Amendment protects people from unreasonable searches and seizures, and immigration agents still need lawful grounds to detain someone. So, when neighbors saw 7 ICE vehicles surrounding ONE car, they started filming. One man, standing at his front door, yells, “You all got nothing better to do.” An ICE agent responds, “I can’t hear you… come down here and talk to me.” Why? He has the same right to criticize federal agents from a public sidewalk as he does from his front door. Then he points out how absurd this situation is… “20 cars for 2 females. You all better wear masks. That’s why you wear fucking masks… so your face doesn’t show.” He’s calling them out for hiding their identities… saying, you’re covering your faces so you can’t be identified or held accountable for what you’re doing. Because remember… these are dozens of armed, masked agents surrounding ONE car, with TWO WOMEN inside… who are U.S. citizens. Instead of ignoring the criticism, the ICE agent walks over and says, “That’s not a threat, is it?” So now saying federal agents should be identifiable, and held accountable, is a threat? The man responds, “Did I threaten you, asshole?” You don’t lose your constitutional rights because an ICE agent doesn’t like being recorded. And criticizing the government isn’t a threat… it’s a constitutional right. And when dozens of masked, armed agents surround two women, question their citizenship, and force them to prove they were U.S. citizens... everyone should be questioning and criticizing the government. Yesterday, ICE reportedly told police that a man “weaponized” his vehicle by “ramming” into an ICE sedan, forcing an agent to fire his gun during an operation in Harrisburg, Pennsylvania. Except… that’s not what the video shows. In the video, an ICE agent rushes the driver’s window with his gun drawn. The agent recklessly waves his gun around, and appears to order the driver to roll down the window. That’s an extreme use of force from the very beginning. Another agent approaches the car, and moments later, they violently smash the driver’s window. And notice how the driver doesn’t try to flee until ICE violently escalates everything. He drives around the ICE vehicle, makes it into the street… not hitting a single ICE agent, or vehicle. Then, AFTER the car is already past every agent, and driving away, an ICE agent opens fire. The law is pretty clear… officers may only use deadly force, against a fleeing person, if they have probable cause to believe that person poses an immediate threat of death, or serious physical injury to the officer, or others. So, where was the immediate threat? The car had already passed the agents… and was driving AWAY. ICE also claimed Lara-Hernandez had a criminal history of assault, and that this was a targeted enforcement operation. Yet, publicly available court records reportedly do not show any active warrants. Federal agents don’t get to point guns at people without legal justification. They don’t get to fire at a vehicle after the immediate threat has passed. And they don’t get to lie to police about what happened. So, when are we going to start holding these agents accountable?

But it gets worse… In Joliet, IL, ICE agents jumped out of their cars, racially profiled a man, began handcuffing him, and forced him into an unmarked vehicle that had its license plate covered. And they did all of this before even confirming who he was. As U.S. citizens began recording the incident, ICE agents started forcing them farther back, even though they were not interfering with the arrest. One of the agents looked at a teenager, who was just standing there and filming, and said, “Step back a little bit.” The teenager wasn’t interfering. In fact, a woman was standing even closer. And then, without warning, the ICE agent violently shoved the teenager to the ground. Moments later, another ICE agent pulled out a taser and threatened the legal observers, despite them remaining away from the vehicle, and not interfering. And after all of that, about 20 minutes later… ICE released the man they had kidnapped because they realized he was not undocumented. Think about how insane that is… A man was detained, handcuffed, and taken away before ICE even confirmed they had the right person. That’s exactly why the Fourth Amendment exists… to protect people from unreasonable seizures by the government. And then there is the issue of an ICE agent shoving a teenager to the ground… Using significant physical force against someone, especially a teenager, who is not posing an immediate threat, not resisting, and not interfering… is excessive force. Federal agents do not get a free pass to assault teenagers because they are standing nearby. The First Amendment protects the right to record law enforcement in public, and government officials cannot use intimidation, or force, to silence people who are lawfully documenting their actions. This wasn’t just about one man being kidnapped…. It was about everyone standing there. A teenager was thrown to the ground. Legal observers were threatened. U.S. citizens exercising their constitutional rights were intimidated. And an innocent man lost 20 minutes of his freedom because ICE believes they are allowed to kidnap anyone they want. So, why are these ICE agents not being held accountable?

And we’re supposed to believe they’re making our communities safer. The video shows ICE agents chasing a man through Albany Park. Two agents grab him and rip his shirt off during the chase, while one of the agents drops a fully loaded magazine… and leaves it there. The man manages to get away and runs across a street, where cars are stopped at a red light. An ICE agent then drive a black SUV into a U.S. citizen’s vehicle in an attempt to cut off the man running. The man is eventually surrounded by agents, when one agent suddenly grabs the man and aggressively throws him to the ground, as multiple agents immediately pile on top of him as he screams for help. As this is happening, residents begin recording what they are witnessing. That’s when another agent enters the scene with his taser already drawn. Despite another agent already standing next to a person filming, he walks directly toward the bystander, shoves them backward, and screams, “Back the fuck up.” The person filming isn’t attacking anyone… or interfering with the arrest. In fact, you can see them nodding and saying “okay.” Yet, the agent continues advancing toward them with a taser. Which all raises some serious first and fourth amendment concerns. And let’s talk about the woman whose car was hit… Her vehicle gets run into, during a federal operation… and then they threatened to arrest HER. And afterward, local police told her they were not given proof of the agents’ identity at the scene. The Jerusalem cross is a Christian symbol dating back to the Crusades that has more recently gained popularity among some far-right and white supremacist groups. In the video, an agent illegally tries to detain an unaccompanied minor, in Long Beach, California. The child has his hands in the air. An agent runs up and hits him in the head with a pistol. Then two agents tackle him and force his head down against the curb. After the child is already on the ground, pinned by two armed adults, another agent brings out a K9, for what reason exactly? Then one agent puts his knee on the child’s neck while another handcuffs him, even though he’s not resisting at all. Unaccompanied minors are supposed to be handled through child-welfare procedures, not slammed into concrete by armed agents. Using a gun as a weapon is deadly force. You don’t get to use deadly force on a child who is standing still with his hands up. An ICE agent was struck by a suspect's vehicle during an attempted arrest in New Jersey, and then opened fire as the driver sped away. The confrontation unfolded along Route 72 in Manahawkin shortly as federal immigration agents moved in to take a suspect into custody. Authorities say the vehicle was hit by gunfire, but the suspect managed to escape and remains on the run. Police say they were not involved in the ICE operation and there is currently no known threat to the public.
