A real “leader” would never flex the fact that they’ve ignored public sentiment of the people who elected him, or reduce the opinions of those people who pay his salary by assuming that they are incapable of also forming an opinion based on fact

A prosecutor’s primary obligation is to the law and the evidence, not to the loudest public opinion of the day. Stating that decisions will not be dictated by shifting sentiment is not “flexing” or dismissing voters; it is the baseline expectation of the office.

Of course. However, while public sentiment needn’t form his ultimate opinion, I’d expect him to have a better understanding of the facts of the case, that led 11 jurors to side with the defendant and throngs of people form the crowd he was addressing. While his obligation is to the law and the evidence, his analysis of this case did not accurately reflect the evidence presented by his own ADAs. Additionally, inherent to any elected position, and one whose decisions are funded by tax dollars, is an obligation to the general public. Hence my critique of this aggressively dismissive statement.

Observers several steps removed from our court proceedings!!!! Isn't it the people's court!?! Thats exactly what is wrong with most DA's, they think they own the system! Doesn't the public sentiment include the family of the victims! Thank you for clarifying what we already know

He had a lot of emotion in his speech - not emotion at the strain put on jurors who were unable to agree and thus caused a mistrial, which I imagine could be quite a burden - but it sounded like his personal feelings, which aren't relevant to his job.

Sure had a lot of feelings for someone whose statement was about not making decisions based on feelings 😉

He is 100% correct. Public sentiment on any criminal case should be ignored. Just because people feel a certain way should never influence a decision of when to prosecute or not prosecute an alleged crime.

It would be a stronger element had the jury aka fact finders not been 11-1 to acquit.

Also ignored the living victims. The grandparents, the father, the aunt, friends & co-workers not to mention the experts on both sides.

I found his comments to be unfair and arrogant. No one is forgetting what happened to these sweet children. No one! What’s infuriating is how many fail to grasp what can & does create psychosis. No.1-administering drug after drug after drug without consequences risking lives.

I think Lindsay was failed on every level.

He’s in a dilemma now. He knows he’ll never get a conviction. The 2M spent in another county to run two trials that failed miserably and caused that DA to retire. Does he bring it to trial again only to have another mistrial and say well we tried or offer a plea deal ?

"Public sentiment" has nothing to do with enforcing the laws you ding dong.
