Videos of masked ICE agents unlawfully detaining a US citizen and resident of Asbury Park were recorded on the morning of Wednesday, April 15 at the corner of Main Street and Bangs Avenue. As seen in the videos, federal agents ignored our constituent’s repeated attempts to identify herself as a US citizen and forced her to be separated from her young children who were watching nearby from their family vehicle. After being detained for 8 hours, she was subsequently released from Delaney Hall in Newark without charges and left with noticeable bruising from being physically handled by ICE agents. ICE's actions of separating families and targeting US citizens continues to be horrific and unacceptable. We have been in contact with the family to offer our support and to connect them with resources. We have also reached out to the Monmouth County Prosecutor and to the New Jersey Attorney General to ask for their assistance in protecting our residents.

The U.S. citizen then gets out of his car, to record the agents’ license plates, and one of the ICE agents has the audacity to say: “Sir, please don’t interfere with our investigations.” Interfere with what investigation? He WAS the investigation. If they’re letting him leave, then there is nothing left for him to “interfere” with. Recording government agents, in public, is protected by the First Amendment, and they don’t get to invent an “investigation” to discourage someone from filming. And this is becoming a pattern. ICE agents are stopping whoever they want… and demanding papers. But that is not how constitutional rights work. ICE didn’t have reasonable suspicion that he had committed an immigration violation… since he is a U.S. citizen. So, detaining him, and demanding that he identify himself, violates his Fourth Amendment rights. U.S. citizens are not required to prove their citizenship, to any law enforcement, simply because they were stopped and questioned. And that’s what makes these encounters so dangerous. When U.S. citizens refuse to comply with these unlawful demands, we’ve repeatedly seen ICE agents escalate the situation with physical force. Citizens have been shoved, dragged from vehicles, pinned to the ground, and pepper sprayed after refusing unlawful demands, or asserting their constitutional rights. And a right isn’t a right if exercising it means you risk being assaulted by the very government that’s supposed to protect it. This isn’t just about immigration anymore. It’s about whether every American can exercise their constitutional rights without fearing they’ll be met with intimidation, violence, or retaliation from federal agents. The agents stop, get out of their cars, and approach THEM. One agent has his GUN drawn, another has his TASER drawn. The agents tell the legal observers to stop following them. A U.S. citizen responds: “We aren’t doing anything illegal. It’s totally legal to follow you.” He is correct. The First Amendment protects the right to record law enforcement, and federal agents, carrying out their duties in public. And federal regulations specifically recognize that people can record publicly accessible federal activity from public sidewalks, and streets, when they aren’t impeding or disrupting operations. Then, the agent says: “Stop following us, you aren’t going to like the outcome.” That is a serious First Amendment retaliation issue. And then it gets even more dangerous. The same armed federal agents, who just threatened these people with weapons and retaliation… surround the citizens’ car and claim THEY are blocking traffic. But look at the video. The only people blocking traffic are the ICE agents… who have now boxed in the citizens’ car. Agents cannot detain someone because they don’t like being watched. A vehicle stop requires reasonable suspicion of an actual legal violation. And recording and observing ICE agents, from a public place, is not obstruction. It is not illegal. Government agents are supposed to be accountable to the people… not the other way around. The First Amendment protects your right to watch and record your government. The Fourth Amendment limits the government’s power to stop and detain you. And neither one comes with an ICE exception.

The First Amendment protects the right to record law enforcement, and federal agents, carrying out their duties in public. And federal regulations specifically recognize that people can record publicly accessible federal activity from public sidewalks, and streets, when they aren’t impeding or disrupting operations. Then, the agent says: “Stop following us, you aren’t going to like the outcome.” That is a serious First Amendment retaliation issue. And then it gets even more dangerous. The same armed federal agents, who just threatened these people with weapons and retaliation… surround the citizens’ car and claim THEY are blocking traffic. But look at the video. The only people blocking traffic are the ICE agents… who have now boxed in the citizens’ car. Agents cannot detain someone because they don’t like being watched. A vehicle stop requires reasonable suspicion of an actual legal violation. And recording and observing ICE agents, from a public place, is not obstruction. It is not illegal. Government agents are supposed to be accountable to the people… not the other way around. The First Amendment protects your right to watch and record your government. The Fourth Amendment limits the government’s power to stop and detain you. And neither one comes with an ICE exception.

If you’re going to protest Federal ICE agents doing their job & use a vehicle as a weapon & try to run over an agent or go with a loaded handgun with one bullet in the chamber & two full magazines & then get into a physical altercation with the agents, I don’t feel sorry for you. Some people have forgotten that these illegal imigrants are coming and harming Americans and y’all think everyone in this country is just going to look the other way? We are not. They need to be deported and our laws need to be enforced. If you are preventing the laws from being enforced, then you have to deal with the consequences of your actions.

🚨BREAKING: ICE/Border Patrol agents followed, racially profiled, and illegally detained a car full of U.S. citizens, in Buffalo, NY. In the video, multiple agents surrounded the car, opened the driver’s door, and start questioning them about who owns the vehicle. They explain that they aren’t the owner, and that they’re all American citizens. And that should have been the end of it. Instead, agents opened the backseat passenger’s door, and continued interrogating them. The passenger even pulled out HIS ID, showing it to the agents, and explicitly tells them they do NOT consent to the agents opening the car door. Being a federal agent does not give you unlimited authority to stop, search, open the doors of, or detain whoever you want. The Fourth Amendment protects from unreasonable searches and seizures. Immigration enforcement does NOT create a blanket exception to the Constitution. Stopping this car, detain U.S. citizens, and opening their doors, wasn’t “just an immigration check.” It was an abuse of government power. And THIS is what happens when agents aren’t held accountable. When there are no meaningful consequences for violating people’s constitutional rights, those violations become routine. Federal agents should NEVER be above the laws they are sworn to enforce.
