I agree with Chamath, that we need a return to Originalism. However, in the context of discussing the Constitution, we must be careful with the phrase “living document.” The judicial philosophy that the Constitution is a “living document” implies that we are to interpret the Constitution based on circumstances and facts as they exist today. That judicial philosophy is the reason for much of the expansion and bloat of the federal government. Instead we must return to Originalism and seek to apply the Constitution as the founders intended. It is “living” only to the extent that we can amend it.
