🤨 Yvette Cooper is already muddying the waters on the new EHRC statutory code of practice that requires single-sex spaces to be based on biological sex. The code has just come into force. It implements the 2025 Supreme Court ruling that “sex” in the Equality Act means biological sex. Single-sex spaces, wards, toilets and changing rooms are for the sex recorded at birth. Full stop. Stig Abell put the simplest possible question to the Health Secretary on Times Radio: “Let’s be absolutely clear about this, single sex ward, someone who identifies as a woman but was born a man would have to go to a male side of the ward rather than a female side of the ward?” Her reply: “The guidance will be set out shortly to make sure there maybe people who will need additional provision or additional arrangements made. It’s very clear where there is single sex arrangements in place it needs to be done on the basis of biological sex.” “Additional provision.” “Additional arrangements.” This is the classic fudge. The law is clear. The code is clear. Biological sex is the criterion. Yet the moment the question becomes concrete, a male patient on a female ward, the language softens into process, guidance, special cases and future arrangements. We have seen this movie before. Clarity on paper, then endless carve-outs, risk assessments, “individual circumstances” and institutional reluctance to enforce the actual rule. Women end up sharing intimate spaces with males while officials congratulate themselves on “balancing rights”. It should be simple. If a service is single-sex, it is for that sex. People who do not belong to that sex use the opposite-sex facilities. No endless reinvention of the wheel. Instead we get the same tired pattern: pander to a tiny minority, amplify the loudest and angriest voices within it, and treat women’s privacy, safety and dignity as negotiable. The overwhelming majority of the public, and the plain wording of the law, are treated as the awkward obstacle rather than the starting point. Cooper says the law is clear. Then she immediately starts talking as if it isn’t. That is how these things get unpicked in practice. Women have every right to be sceptical.

A clear example of why language matters in reporting on "men in women's sports." This weekend, biological male AB Hernandez — a California high school senior who previously competed in girls' volleyball — switched to track and field and dominated the girls' jumping events. Female athletes trained for years watched a male competitor take the podium and the victories that should have been theirs. A guest in this news clip this morning rightly described the scene as "discouraging" and "heartbreaking" for the girls who know they "cannot beat a male." Yet even on a conservative outlet, FOX News, the on-air host, Carley Shimkus, repeatedly referred to Hernandez as "she," "her," "biological trans daughter," and "trans female daughter." The segment highlighted Hernandez's mother's claim that the impact on her child was so severe she had to take a leave from work to protect her "trans female daughter's safety and emotional well-being," framing the male athlete as the primary VICTIM. This is not an isolated slip. Mainstream outlets (PBS, NYT, ESPN, etc.) routinely use female pronouns and identifiers for male competitors as a matter of corporate policy, presenting them as women. That framing obscures the biological reality for viewers who aren't steeped in the debate: a male athlete identifying as female is competing in the female category, displacing girls from medals, podiums, scholarships, and records. The core issue is straightforward: Should biological males compete in women's and girls' sports? Fairness, safety, and the integrity of female categories depend on sex-based divisions, not self-identification. Decades of sports science, physiology, and performance data show consistent male advantages in strength, speed, power, and jumping events that do not disappear with testosterone suppression or identity. When even conservative outlets such as Fox adopt the preferred pronouns and "trans daughter" language without clear qualification, it muddies that simple reality for the broader public. Casual viewers hear "she won the girls' triple jump" and assume it's a female athlete — not a male one who just posted a three-foot advantage over the best girls. Accurate journalism doesn't require snark or cruelty. It requires precision: biological male, male athlete, competing in the girls' category. The girls who trained, competed, and lost opportunities deserve that clarity. So does the public trying to understand why this policy debate exists in the first place.

Do you genuinely believe children can be born in the wrong body? Peter Tatchell: I believe there are children who genuinely believe they are not Julia: But they aren’t born in the wrong body. What do they need to be treated for? Peter: If they’re genuinely trans, which they are in 99% of cases. Julia: What’s that statistic from? Where does the 99% figure come from? Peter: We know from the evidence that puberty blockers have benefited thousands of young people Julia: No, we don’t. That’s not what the studies say. Peter: You keep interrupting me. Don’t be rude, Julia. Julia: Then stop saying things that aren’t true. Peter: Hundreds of thousands of young people have gone through trans treatments successfully and happily around the world. Julia: There’s no adequate follow-up research to make that claim. Did you actually read the Cass Review? Peter: Yes. And Cass did not say young people should be denied puberty blockers or hormone treatment. She said they should be used cautiously. Julia: A large proportion of children who think they’re trans either turn out to be gay and/or are autistic. Isn’t that a strong argument against giving children irreversible treatment? Peter: That’s why the process is slow and rigorous. Nobody goes into a clinic and gets treatment the next day. It can take years. Julia: That simply isn’t true for everyone. Let’s move to another issue. After the Supreme Court judgment, some organisations have said they’ll continue allowing people to access single-sex spaces based on gender identity. If the ruling says biological sex matters, are they right to continue? Peter: There are two important issues: women’s rights and trans people’s rights. We need to reconcile both. Biological sex is a reality, but gender identity is different and, in my view, equally valid. Julia: No. Women are defined by biological sex. Someone who is biologically male can believe they’re a woman, but that doesn’t make them a woman in law or reality. Peter: The Supreme Court didn’t define biological sex Julia: It was very clear that women are defined by biological sex. We know what biological sex is. So how can you be a woman if you’re a man?
