But now, advance parole is considered a departure, which could be a problem for a lot of DACA recipients. So if you have more than 6 months of unlawful presence, meaning you got DACA after turning 18 and 6 months, or you had an expiration in between renewals of more than six months, now it's gonna be an issue when you leave on advance parole 'cause you won't be able to come back without a waiver, and those can take up to three years to process while you're outside the country before you're allowed back in. Now, the most important question is, is it retroactive? No, meaning if you already did advance parole and you're wanting to adjust status in the United States, you should be good to go. So it's an issue for anybody else wanting to apply in the future, however, advance parole is not even a thing right now anyway. The Trump administration has stopped adjudicating them altogether, and this might be the reason why. Second issue, a lot of DACA recipients had removal orders from when they were little because of their parents. Now, if you have a removal order and you're leaving and coming back on advance parole, it'll technically execute your removal order, and you will not be allowed back in” “The BIA has been completely overhauled by Trump, so this surprises no one, and it shouldn't.
