Her lawyers are potentially attempting to avoid trial by filing the motion in the first place because they are asserting that the original petition is so factually weak that the judge can make a ruling based on the pleadings alone. Activist employees are a liability. Reddit is now exposed to discovery and damages.

Ethan states that there are technicalities at play, but they are still negotiating the terms of the settlement. From my perspective, it seems Ethan isn't taking the path to file a notice of discontinuance only, and wants to settle. A settlement could help Ian, because Ian's attorneys can add a stipulation for Ethan not to sue further. It looks as if this case isn't going to trial, or Ethan doesn't have the intention to take it to trial, and Ian may have possibly jumped to conclusions by seeing the deadline dates. I also wonder if Ian even talked to his attorney and asked for an update before firing up a livestream, because he would have naturally known they are in settlement negotiations had he asked.
