Illegal immigrants do not have constitutional due process rights. And judges can’t magically wave a pen and decide that they suddenly do, because illegal immigrants only have the rights Congress provides them by statute. January 6th defendants didn’t get this level of due process rights. The Trump administration must take an aggressive approach to ensure these illegal immigrants do not receive due process rights.

You cannot run to a federal district court in a liberal stronghold and ask a district court judge to upend the process to free an illegal immigrant. The Supreme Court ruled 9-0. That rarely happens. Justice Jackson, the most liberal member of the Court wrote the majority opinion. Congress writes the nation’s immigration laws. The executive branch enforces them and adjudicates them. The law applies different due process standards to illegal immigrants than to American citizens. American citizens receive greater due process protections. They receive Article III due process. Illegal immigrants do not. Thanks for having me, Rob Carson Show.
