While Tommy was stopped by authorities in July 2024, he was not formally charged under the Terrorism Act until October 2024. One of the officers involved in the incident allegedly stated that he became suspicious because Tommy wouldn't make eye contact, was driving alone, and was in a high-value vehicle while he was being detained. Ezra discussed why the basis for Tommy's original detention and his charge under the Terrorism Act are likely not legitimate. "What was clear, was that the cops who stopped Tommy didn't ask him a single question about terrorism. They only asked him about his politics, about news, about things that you can Google," he said. "And that is not enough under the law to stop someone using the mighty Terrorism Act, which lets you arrest someone for any reason or no reason, for six hours, interrogate them, and they don't have the right to remain silent," Ezra continued. This is deeply misleading. He’s referring to Schedule 7 of the Terrorism Act, which gives police broad powers to question travellers at ports and borders to see if they’re involved in terrorism. Under Schedule 7, you must answer certain questions - things like your name, address, travel plans, and nationality - and hand over requested documents. Refusing in that setting can be a criminal offence. But this applies only during that specific stop and only for questions related to terrorism. Once the stop ends, your normal rights return. So no, Ezra - the UK hasn’t “abolished” the right to silence. You just can’t refuse basic questions during a terrorism screening at the border.
