Only a citizen may contribute in cash or in kind to the funds of a political party. A firm, partnership, or enterprise owned by a citizen or a company registered under the laws of the Republic at least seventy-five percent of whose capital is owned by a citizen is for the purposes of this Act a citizen. Section 24: No Contribution by Non-Citizens. A non-citizen shall not directly or indirectly make a contribution or donation or loan whether in cash or in kind to the funds held by or for the benefit of a political party and no political party or person acting for or on behalf of a political party shall demand or accept a contribution donation or loan from a non-citizen. Section 25: Contraventions of this Part. Where any person contravenes section 23 or 24, in addition to any penalty that may be imposed under this Act, any amount whether in cash or in kind paid in contravention of the section shall be forfeited to the State and the amount shall be recovered from the political party as debt owed to the State. The political party or person in whose custody the amount is for the time being held shall pay it to the State. A non-citizen found guilty of contravention of section 24 shall be deemed to be a prohibited immigrant and liable to deportation under the Aliens Act, 1963 (Act 160). The provisions of sections 23 and 24 do not preclude a goverment of any country or a nongovernmental organization from providing assistance in cash or in kind to the Commission for use by the Commission for the collective benefit of registered political parties. To be sure, this call for extrajudicial killing is reckless, irresponsible, and unlawful. And it constitutes a clear threat to life and risks inciting a breakdown of public order. The call strains the boundaries set under Section 24(1) of the Cybercrimes Act, which criminalises the knowing or intentional transmission of messages via electronic means (including those amplified on broadcast platforms and social media) that pose a threat to life or are intended to cause a breakdown of law and order, which carries a fine of up to ₦7m or imprisonment of up to three years or both. Additional liabilities will likely be triggered under the Criminal Code for incitement to violence and related offences. We have seen what transpired today at the Appeal Court and we want to say very clearly that the judgement is not acceptable to all of us in the Labour Party led by my humble self. I want to say very clearly that the judgement is against all known principles of law. The courts, the Supreme Courts and all courts in Nigeria have stated very clearly that the issues of leadership of a political party is an internal affairs of a political party. It is also not true and I disagree when people say that the tenure of this executive has expired. That is untrue and very unacceptable to us. Nigerians will recall that on the 27th of March 2024, we had a valid convention that was held in Nnewi and that convention is still valid and subsisting for 4 years. I want to say that the court today didn't look at that before arriving at the conclusion that the tenure has expired. I must also say clearly that the Umuahia meeting which produced the Caretaker Committee was also against the Labour Party constitution. It is only the National Chairman and National Secretary of a Political Party who has the power to convene any NEC meeting of any of sort. I want to say very clearly that we are going to appeal that decision. Today's decision of the Appeal Court is not acceptable to us and we reject it in its entirety. This is a very disturbing extract of an interview with Naledi Pandor. In essence, the existence of an independent Afrikaans institution she finds incompatible with any notion of a society. Traces of this should rather be expunged as she phrased as “we are too complacent with our freedom”. What she is advocating for is wide-spread public condemnation of anything that resembles the cultural expression of Afrikaans as language or Afrikaners as a people. Not only that - the “we” she refers to is stated in a totalitarian sense. Not an individual expressing an opinion, but the body of the state that should disallow by force or legislative means, anything that does not conform to their thwarted societal view. This passage of Nineteen Eight-Four comes to mind: “Obedience is not enough. Unless he is suffering, how can you be sure that he is obeying your will and not his own? Power is in inflicting pain and humiliation. Power is in tearing human minds to pieces and putting them together again in new shapes of your choosing…there will be no love, except the love of Big Brother.” As for AfriForum and other institutions of the Solidarity Movement, we see this. We will not succumb to naivety of the intentions that the political order that Pandor aspires to. On the basis of mutual recognition and respect, we shall build a future. Our notion of freedom does not derive from a state that determines how we should think and act, but rather the freedom of individuals and communities giving expression to their talents and capabilities.
