In this particular situation; yes. It is OK for them to do that when they have a complaintant alleging criminal behavior. (The car prowling, potential trespass) BUT people will often lie and embellish, and some cops tend to do it (even worse). To be trespassing you must be notified: in moat jurisdictions, a fence, visible sign or property improvement on non-commercial property always means you are trespassing. For properties with a function that serves the public, you must be notified to leave before it is enforceable. This is where the cops usually fail, when scared/subversive people want someone removed but are too afraid to approach (and thats fine. I don't like that behavior but it is understandable)... and police seize the person and arrest them for 'resisting' and 'obstruction' obstruction' This is why it's important to clarify two things: 1. Ask if THEY are detaining YOU. Not "am I BEING detained" - you are not the actor. They are. Clarify that. 2. Express your statements and let them control the interaction within reason (personally I grew out of the blanket statements/propoganda from the auditor circles as it makes you seem like a target. An attorney would likely say to tell them clearly you'd like to be on your way, and want an attorney before answering questions, then stfu is the best course of action) The request for an attorney must be absolutely unambiguous. Not 'I think i want an attorney' or 'I would like one if' or 'I WOULD like one'. These are hypothetical and vague/noncommittal. Does not work.

Somewhere along the way, the prevailing belief among police became: if they “get a call,” that alone is reasonable suspicion to demand ID. We see the same thing happen over and over. I think if a cop gets a call about a “suspicious person,” they should pull up and watch. See whether a crime is happening or about to happen. The officer can run plates, photograph the vehicle, and even speak with you. There is no need to escalate into a detainment and forced ID when no legitimate justification exists. That behavior is tyrannical. It should not be supported in a free society. ❓Why do so many cops treat a 'suspicious person' call as a blank check to detain you? ❓Should a vague phone call alone let police stop and ID anyone they want?

Two police approach a man standing on the street recording. One of them tells him "the don't want you coming back over there" and asks for ID. The man asks the officer's name and badge number. The officer says, "I don't need it," then advances. Without delay the man is under arrest. Because the officer said he had asked him for it TWICE already. ID on demand because I asked and do it quickly.....or go to jail...in America. Two questions on this video. ❓Does anyone know where this is? ❓Does anyone know the outcome? I've been unable to find the answers online.

⭐️This Oakland County, MI. sheriff sergeant doesn't take no for an answer.... because he's the POLICE and he can get away with it. His two buddies just standby and watch as he stomps on the Fourth Amendment. A man was recording on public property near the sheriff's employee parking lot when he was confronted by Sgt. T. Vida who requested ID. When the man declined Sgt. Vida told him he was detained and without permission went through his pockets and wallet to find an identification. He wrote down the information, gave the wallet back and told the man he was free to go. He said he took the ID absent suspicion of a crime and without permission, because "I like to know who I'm talking to." The Sheriff's Office is the largest full service Sheriff's Office in the State of Michigan covering a population of 1.3 million residents. ❓The other two deputies who watched an illegal search and said nothing, are they protecting the Constitution or the clique? ❓If this is how he treats a guy with a camera on public property, how does he treat people without one? ❓Is this professionalism, or just uncontrolled power with a badge?

🚨August 2021 — Coeur d’Alene, Idaho. State-run liquor store. Amagansett Press (Jason Gutterman) and his son Jason is standing ~20 feet from the door on the public walkway/parking area, filming. He never enters the store. Staff come out, claim he’s “bothering customers,” tell him to get off “their property,” and call police when he refuses. Officer Kaiafa arrives, asks staff if they want him trespassed, then tells Gutterman she needs his ID to formally trespass him and enter it in the system. He points out it’s a state-owned liquor store, he’s on public property, committed no crime, and there is no lawful basis to trespass him from a public sidewalk. He asks for the property line and a supervisor. She continues demanding ID. He produces it under threat of arrest/detainment. She runs it, hands it back, and leaves. No arrest. No citation. Filming in public from public property is legal. A government liquor store’s sidewalk is not private property.
