The car is towing the transit at about five miles an hour on a main fast flowing road, the truck came round the bend and saw them late. Feel a bit sorry for the poor cu*t.

What on earth was that lorry driver doing behind the wheel?

I almost blamed the SUV but I had to think maybe it was an emergency or something beyond the drivers control. But looking closely again the big Truck had quite a distance and time to slow down!

The fact someone thinks this is anyone’s fault but the lorry driver is baffling

The removal and or use as a lane of the hard shoulder is cretinous and a risk to life. Any deaths should be brought to court and the people who decided to do this must face industrial manslaughter charges.

The car and the van that it was allegedly towing may have been at fault for going too slow, but to all those saying that the red lorry had no time to stop after coming round the bend: What if it had just been a traffic jam that the car and van were at the tail end of? The accident still would have happened. If you are going around a bend and can not see the road ahead beyond a certain distance, you should adjust your speed in anticipation of any change in the flow of traffic. Also, the other lorry behind managed to brake and stop in a much shorter distance when he/she saw the red lorry lose control (although I realise that the lorry behind may have been carrying far less weight, so this point may not be totally relevant). It seems that the red lorry reacted far too late.

Whilst the lorry driver is clearly at fault here, I have to wonder (a) why the car/van aren’t using what exists of a “shoulder” there, and (b) why the (presumably) broken-down van didn’t call the police / highways England (whichever is responsible on this piece of road) to get an escort / assistance. Hard to see any of the drivers escaping entirely without action from this one.

Everyone making claims this was th elorry drivers fault clearly have no idea that stopping a fully laden HGV is not the same as them stopping their Renault Clio

There are two drivers at fault. The cement truck driver got it wrong. The car towing the van is wrong too: the offence is driving without reasonable consideration for other road users under Section 3 of the Road Traffic Act 1988.

The truck 🚚 never had a chance If you think the trucks at fault get off UK roads Full load down hill slightly. The car is towing a van! Without a straight bar looks like rope which is illegal on A roads i think. Another rule is if you are towing another vehicle, the car pulling must have a bigger engine than the thing its pulling. Otherwise you get what you see, loss of momentum into stall, full engine stop. The truck 🚚 has mass coming off a blind bend and gravity kicks in.

Its a driving offence to actually drive too slow. The Jeep should NEVER be towing a van, and at less the 50mph on motorway. 100% SUVs fault

I can't see any hazard lights flashing on the car or van getting towed, they are both been illegal aswell, the truck driver had enough time to slow down though

He’s doing 57mph in a vehicle that is heavy and carrying a lot of weight. He reacted a little slowly but avoided all other vehicles including the numptys doing 3mph and slowing down. No doubt attempting to save money by not having the Transit van recovered properly.

The only way that he couldn’t have seen the car and van in front of him, was if he wasn’t concentrating on the road ahead of him. I hope the police check his phone to see if he was on that.

I'm afraid that liability will completely fall on the truck driver. The proximate cause is that driver's inability to stop and being forced to maneuver. Doesn't matter if the tow was illegal.
