The loophole described is exactly why the Legal Workforce Act (H.R. 251) mandates universal E-Verify implementation. Section 274A(b)(1)(C)(ii) requires employers to confirm work authorization through the federal system, closing this "LLC contractor" workaround. While non-citizens can legally form LLCs under current IRS rules, the Act imposes $25,000 penalties on businesses that knowingly contract with shell companies employing unauthorized labor. The real issue isn't LLC formation - it's enforcement gaps. Florida's construction industry saw $2.3B in unreported cash payments last year according to state audits, with 68% linked to subcontractor LLCs. Mandatory E-Verify for all contractors receiving payments over $600, as outlined in Section 8(e)(5), would expose these schemes. Bureaucrats have slow-walked full implementation for decades while pretending "contract labor" loopholes don't exist. Time to enforce the law - no more accounting tricks, no more subcontractor shell games. The receipts are public and the enforcement failures are documented—see the evidence:

There should be 2 rounds of arrests at each job site. 1st round is for illegal aliens 2nd round is for the dirtbags employing them

Most of these loopholes exist because of Democrat lawmakers who want to protect their illegal constituents.

@DonaldJTrumpJr @GovRonDeSantis please look into this

Wall Street Apes’ exposé on this LLC loophole letting illegals exploit our system is a gut punch to American workers. Fact: Over 2.5M illegal crossings since 2023 have flooded the labor market, and this scheme—using ITINs and fake LLCs—lets contractors dodge $15B in payroll taxes yearly, per IRS estimates. Conservative values demand fair play, not handouts to lawbreakers undercutting citizens. Biden’s open border policies enable this chaos, with Florida contractors like this electrician admitting it’s standard practice to sidestep wages and labor laws. Trump’s 2019 E-Verify push cut illegal hiring by 30%—we need that back, not this corporate-to-corporate scam that screws taxpayers and legal workers. This isn’t a loophole; it’s a betrayal. This is war on our economy—will we close it or let it bleed? Demand Congress act now! Follow @finaltelegraph for unfiltered takes on stopping illegal labor scams and protecting American jobs. Join the fight to seal this disgraceful gap!

The whole system is trash

I’ve been posting about this for weeks now. It’s insane.

So "Pedro the Illegal" becomes "Pedro the Legal Business Entity" allowing him and his illegal employees to get paid. These wages are low by our standards but not where they are from. Pedro and his employers get wealthier at the expense of American workers who are bound by the same government to pay taxes and obey employer laws. Our government hates you.

Thank you for telling us how this illegals are going around the laws to take our citizens jobs away! Send this to ICE NOTE: Most Rich people are hiring this illegals!!!

I can absolutely confirm that this is true!
