Reasonable suspicion is fine but the proper paperwork is required and a drug test is mandatory especially if the employee is willing to take one. If he’s clean, he returns to work. If he’s not, termination is certainly an option.

He has a wrongful termination claim. Firing for that requires two members of management to even suspect something and request a drug screen. I know im a senior member of management and we have hr training over this kind of stuff. Just smelling like something is not grounds.

When management says your gone ain't no one to help you but a lawyer. Collect all the info for your dismissal and contact a lawyer immediately. Make sure to remain civil. This is the most important part because they will use any hostile actions against you. I know it is hard 🤣🤣

Can't be smoking before work at a job like that and expect leniency. That's like showing up to work drunk, which in some jobs might not be the end, but when you're working construction around heavy machinery, being intoxicated can cost lives. The boss didn't have much choice.
