ICE is routinely harassing, detaining and even arresting U.S. Citizens. From Jessica Yellin - This is Mubashir. He’s only using his first name to protect his family from retaliation. He’s 20-years-old and a U.S. citizen, Mubashir says he left his apartment for lunch and within seconds was tackled and... detained by ICE agents during his lunch break — even after he repeatedly told them he was a citizen and offered to show his passport. Video from Cedar-Riverside shows masked agents chasing and grabbing him, putting him in a headlock, and driving him to a federal building. He was held for hours and released only after someone allowed him to prove his citizenship. Even then they told him to walk home in the snow. The mayor and police chief called the stop unlawful and constitutionally alarming — saying Mubashir was targeted for “simply walking down the street and looking Somali.” This occurred in Minneapolis a month ago - December 10th. I’m sharing this so you’re aware that the ICE abuses we’re seeing since Renee Good’s killing is - aren’t new. They’re getting to be more rampant and the nation is paying attention now. The video shows agents slamming Mubashir into metal poles as they wrestle him into handcuffs. He’s not fighting. He’s not resisting. 🚨Another day, another video of ICE agents illegally demanding a U.S. citizen prove their citizenship, in Brownsville, TX. In the video, ICE agents have a U.S. citizen boxed in with their vehicles. After demanding that he show his ID, the U.S. citizen asks if he is free to go, and then tells them to get the F away from his car. Instead of going back to their own cars, the agents tell him to “chill”… after they had already illegally detained him and demanded identification. The U.S. citizen then gets out of his car, to record the agents’ license plates, and one of the ICE agents has the audacity to say: “Sir, please don’t interfere with our investigations.” Interfere with what investigation? He WAS the investigation. If they’re letting him leave, then there is nothing left for him to “interfere” with. Recording government agents, in public, is protected by the First Amendment, and they don’t get to invent an “investigation” to discourage someone from filming. And this is becoming a pattern. ICE agents are stopping whoever they want… and demanding papers. But that is not how constitutional rights work. ICE didn’t have reasonable suspicion that he had committed an immigration violation… since he is a U.S. citizen. So, detaining him, and demanding that he identify himself, violates his Fourth Amendment rights. U.S. citizens are not required to prove their citizenship, to any law enforcement, simply because they were stopped and questioned. And that’s what makes these encounters so dangerous. When U.S. citizens refuse to comply with these unlawful demands, we’ve repeatedly seen ICE agents escalate the situation with physical force. Citizens have been shoved, dragged from vehicles, pinned to the ground, and pepper sprayed after refusing unlawful demands, or asserting their constitutional rights. And a right isn’t a right if exercising it means you risk being assaulted by the very government that’s supposed to protect it. This isn’t just about immigration anymore. It’s about whether every American can exercise their constitutional rights without fearing they’ll be met with intimidation, violence, or retaliation from federal agents. If federal agents can stop U.S. citizens, demand they prove who they are without lawful justification, and then escalate when people refuse… Then nobody’s constitutional rights are safe.

In Atlantic City. He showed them his license. They dismissed it. He showed them ANOTHER form of ID. They STILL kept interrogating him about where he lived, who he lived with, whether Venezuelans lived in his home, who had been in his car, and whether the vehicle was registered to him. So, why was this U.S. citizen stopped, surrounded, and interrogated in the first place? The Fourth Amendment does not disappear because agents “suspect” someone might be undocumented. In the video, a U.S. citizen is standing in a parking lot while agents illegally racially profile him and try to “run” his information. They can’t identify him. Bystanders repeatedly tell the agents he is a U.S. citizen and that they cannot take him. The agents ignore everyone, walk him to their vehicle, and take him anyway. An hour and a half later, after illegally detaining and transporting him, they drop him off miles from where they kidnapped him. That is an unlawful detention. That is an unlawful arrest. That is government agents disappearing a U.S. citizen because he didn’t have “papers” on him. And this is exactly why you never answer ICE’s questions. The only thing you should ever say to an agent is: “Am I being detained, or am I free to go?” If they are stopping you, they should already know who you are.

According to the man filming, ICE followed him until they initiated a stop. As they detained the U.S. citizen, an agent reached into his vehicle and tried to take his ID. The man asked, “Why are you snatching my stuff?” The agent replied, “I’m not snatching your stuff. This is a lawful stop. Are you going to give me your ID?” Except… if this man is a U.S. citizen, what exactly was the lawful basis for the stop… and running his ID? The Fourth Amendment doesn’t become meaningless just because an ICE agent thinks someone looks undocumented. And here’s what makes even less sense… even if the vehicle was registered to someone who was undocumented, his driver’s license would immediately show he wasn’t that person. So, why was ICE still running his information through their system? He says he inadvertently made eye contact with an ICE officer who was lurking in an alley watching cars go by. 🚨BREAKING: Border Patrol just illegally arrested a U.S. citizen… a TEENAGER… in Richfield, Minnesota. The teen was working at Target when agents tackled him and arrested him, while his passport was in his pocket, fully identifying himself as a U.S. citizen. None of it mattered. Why? 🚨ICE agents were filmed committing a hit and run AFTER racially profiling and illegally detaining a U.S. citizen. In the video, ICE agents have the man completely boxed in with vehicles, surrounding him on multiple sides while he films the encounter. One of the federal vehicles is backed directly against the front of his car as the man asks who is going to pay for hitting his vehicle… The agents ignore him, get in their cars, and drive away. Think about how insane this is… Federal agents boxed in an American citizen based on how he looked… damaged his vehicle in the process… then fled the scene once they realized he was a U.S. citizen. If a regular person hit someone’s car and then drove away, they would be arrested and charged. But, for ICE agents… it’s just another day.

And forcing someone into a compliance position on the ground without probable cause constitutes an unlawful detention under the Fourth Amendment. After agents confirm he is a U.S. citizen, the man stands up and begins yelling… visibly angry and shaken. The man is yelling at agents for swarming his car at gun point, a U.S. citizen, and forcing him out. Saying, “I could’ve died.” ICE agents then try to claim it was because of his registration. A line they often use, that still doesn’t justify their actions. What this video shows is federal agents detaining first, forcing compliance, then checking legality afterward… the opposite of how policing in a constitutional system is supposed to work. If ICE can force a U.S. citizen to the ground over a car they happen to be driving, citizenship no longer protects you. This isn’t a minor mistake. He even offered to show his ID… and they didn’t believe him. Instead, they took his phone, wallet, and keys, shoved him in their car, illegally transported him to another location, questioned him about where he was “really” from, for 2 hours, and refused to let him call anyone. Then, once they realized he was a U.S. citizen… they let him go without explaining why he was detained. The Fourth Amendment protects people from unreasonable searches and seizures…. ICE agents don’t get to kidnap someone, from a coffee shop parking lot, without reasonable suspicion or probable cause. The Fifth Amendment guarantees due process…. Holding someone against their will while refusing to tell them why, or denying them access to contact anyone, is a constitutional violation. And the Equal Protection principles mean the government can’t target people simply because of their race, ethnicity, or the language they speak. If you’re okay with constitutional rights disappearing the moment someone has the wrong last name, or skin color… You were never defending law and order.
