🚨BREAKING: (CHICAGO SUBURBS) ICE agents pulled a GUN, and a TASER, on unarmed U.S. citizens for recording them from a public sidewalk… while threatening, “you aren’t going to like the outcome.” In the video, legal observers are standing on a public sidewalk recording ICE agents. The agents stop, get out of their cars, and approach THEM. One agent has his GUN drawn, another has his TASER drawn. The agents tell the legal observers to stop following them. A U.S. citizen responds: “We aren’t doing anything illegal. It’s totally legal to follow you.” He is correct. The First Amendment protects the right to record law enforcement, and federal agents, carrying out their duties in public. And federal regulations specifically recognize that people can record publicly accessible federal activity from public sidewalks, and streets, when they aren’t impeding or disrupting operations. Then, the agent says: “Stop following us, you aren’t going to like the outcome.” That is a serious First Amendment retaliation issue. And then it gets even more dangerous. The same armed federal agents, who just threatened these people with weapons and retaliation… surround the citizens’ car and claim THEY are blocking traffic. But look at the video. The only people blocking traffic are the ICE agents… who have now boxed in the citizens’ car. Agents cannot detain someone because they don’t like being watched. A vehicle stop requires reasonable suspicion of an actual legal violation. And recording and observing ICE agents, from a public place, is not obstruction. It is not illegal. 🚨This is one of the most disturbing ICE brutality videos I’ve seen in a long time… Another angle of this incident shows ICE agents suddenly rushing protesters outside the Newark ICE Facility, then continuously shoving U.S. citizens toward the wheels of a MOVING TRUCK… until an activist’s LEG is run over. In the video, ICE agents are arresting a man while people film the arrest. A person tries to get information from the man, when an ICE agent suddenly moves toward her and another woman, pushes them back, while pointing an expandable baton at them, in a threatening manner. One woman tells the agent that she has a right to record… which he responds by shoving her. The agent then threatens the person filming, pointing his baton at them, and yells, “don’t follow me.” As if simply observing law enforcement is a crime… especially when there’s a clear physical barrier separating them. The First Amendment protects the right to record law enforcement in public. People filming, and not physically interfering, are exercising protected speech. The Fourth Amendment protects against unreasonable seizures and excessive force. Physical pushing and threatening citizens with a baton, when they are not resisting or obstructing, raises serious questions about whether force is being used lawfully, or as intimidation. Excessive force standards, used by federal law enforcement, requires any force to be objectively reasonable based on an actual threat or interference… not simply the presence of people recording, or criticizing them. So, once again… Filming and observing is not interference. Standing in public is not a threat. And when someone stopped to film it… an ICE agent, in an unmarked vehicle, drove directly toward them, using their vehicle to intimidate them for exercising their constitutional right to record law enforcement. In the video, ICE agents stopped a man walking down the street and demanded he show them his ID. A person driving sees this, stops their car, and begins filming from across the street. Then, another agent, sitting in an unmarked vehicle, on the other side of the street, drives directly toward the person filming, and stops inches from the side of their car. The agents eventually let the U.S. citizen go… get into the vehicle that is still parked inches from the person filming, and then wave at them like this is all some kind of joke… and drive away. The Fourth Amendment protects people from unreasonable seizures. And when armed federal agents stop someone and demand identification, that is not a casual conversation. And the First Amendment protects the right to record government agents performing their duties in public, as long as you are not actually interfering with what they are doing. (Filming from across the street is not interfering) So, when armed federal agents stop someone walking down the street and demand proof of citizenship, while another agent uses a vehicle to intimidate someone documenting it, there are some serious constitutional questions that need to be raised. You should not have to prove you belong, in your own country, to armed government agents. And you should not be intimidated for documenting them. There is only one solution to the free speech crisis in Australia - a constitutional amendment which prohibits the government from curbing what information you can and cannot access. Most constitutional amendments fail. A free speech amendment will easily win.

🚨In Key West, an ICE/Border Patrol agent threatened to PULL A U.S. CITIZEN OUT OF THE CAR because he cursed at an agent… then had the audacity to tell the U.S. citizen to “learn your laws.” So, let’s learn them. In the video, Border Patrol agents pulled over a car of U.S. citizens and demanded everyone hand over their IDs. When the passenger says, “Bitch, fuck you,” an agent asks what he said and then threatens to pull him out of the vehicle if he “says one more thing like that.” The passenger correctly asks: “For what? That’s freedom of speech.” The agent responds: “That’s not how that works. Learn your laws.” Oh, we’re going to… Cursing at a government agent is not, by itself, a crime. The First Amendment protects a significant amount of verbal criticism, insults, and profanity directed at law enforcement, as long as it is not a physical threat. The government cannot punish people simply for verbally challenging or criticizing law enforcement. And it gets even worse. After the passenger calls the agent a “fucking white cracker,” the agent asks what he called him… and then tells another agent he is “thinking of calling in and arresting this guy.” For what? Because he hurt your feelings? The government does not get to arrest someone for speech they don’t like. And yes, Border Patrol has special authority near the border. That includes operating immigration checkpoints where agents can briefly stop vehicles, without individualized reasonable suspicion, for immigration questioning. But, that is different from a roving patrol stop. When not operating at a checkpoint, Border Patrol needs reasonable suspicion to pull over a vehicle for immigration questioning. And even at a checkpoint, the agents’ authority is not unlimited. A checkpoint stop does not automatically give them the right to search the vehicle, indefinitely detain people, or arrest someone because they said something an agent didn’t like. The Constitution does not say… “You have freedom of speech, unless a federal agent gets offended.” It says the government cannot punish you for exercising that right. And perhaps the most important part of this entire video is… The passenger knew his rights better than the federal agent threatening him. The agent told the U.S. citizen to learn his laws… But maybe the agent should have learned them first.

🚨BREAKING: A video shows what appears to be an ICE agent, masked and in plain clothes, stopping a car… and photographing the person inside to add to a government database, in California. He doesn’t identify himself… doesn’t say a word… just walks up, takes a picture, then walks to the front and photographs their faces through the windshield… and then leaves. This is not normal. If this is ICE, and not a random stalker, then what you’re watching is a federal agent taking photos of a U.S. citizen, who has not violated any laws… and adding them to a database. Federal agents are not allowed to target people without reasonable suspicion. They cannot conduct investigative actions based on a hunch… or how someone looks… and they absolutely cannot use intimidation tactics against people doing nothing wrong. So, what crime justifies this? What probable cause exists to photograph someone’s face like that? There isn’t one. We all have the right to document law enforcement in public… But now, we’re watching the reverse. Law enforcement documenting YOU, building government databases on YOU. Without identifying themselves, without explanation. That’s government surveillance. This is how rights disappear… quietly… piece by piece… Until exercising your first amendment rights gets your face logged into a government system you never consented to. 🚨BREAKING: An ICE agent was just caught on video violently shoving a TEENAGER to the ground, in a Chicago suburb. But it gets worse… In Joliet, IL, ICE agents jumped out of their cars, racially profiled a man, began handcuffing him, and forced him into an unmarked vehicle that had its license plate covered. And they did all of this before even confirming who he was. As U.S. citizens began recording the incident, ICE agents started forcing them farther back, even though they were not interfering with the arrest. One of the agents looked at a teenager, who was just standing there and filming, and said, “Step back a little bit.” The teenager wasn’t interfering. In fact, a woman was standing even closer. And then, without warning, the ICE agent violently shoved the teenager to the ground. Moments later, another ICE agent pulled out a taser and threatened the legal observers, despite them remaining away from the vehicle, and not interfering. And after all of that, about 20 minutes later… ICE released the man they had kidnapped because they realized he was not undocumented. Think about how insane that is… A man was detained, handcuffed, and taken away before ICE even confirmed they had the right person. That’s exactly why the Fourth Amendment exists… to protect people from unreasonable seizures by the government. And then there is the issue of an ICE agent shoving a teenager to the ground… Using significant physical force against someone, especially a teenager, who is not posing an immediate threat, not resisting, and not interfering… is excessive force. Federal agents do not get a free pass to assault teenagers because they are standing nearby. The First Amendment protects the right to record law enforcement in public, and government officials cannot use intimidation, or force, to silence people who are lawfully documenting their actions. This wasn’t just about one man being kidnapped…. It was about everyone standing there. A teenager was thrown to the ground. Legal observers were threatened. U.S. citizens exercising their constitutional rights were intimidated. And an innocent man lost 20 minutes of his freedom because ICE believes they are allowed to kidnap anyone they want. So, why are these ICE agents not being held accountable?
