RTI = RIGHT TO DENY INFORMATION? ▪️The RTI is under attack like never before - if the Modi govt has its way the Right To Information may well become the Right To Deny Information. Because it’s likely that you may no longer get the information you seek from your govt. Read on 👉How is RTI under attack? • Amendment of Section 8(1)(j) of RTI under the Digital Personal Data Protection Act (DPDP Act), 2023 makes RTI redundant and ineffective 👉What has Modi done to dilute RTI? • Govt has amended Section 8(1) (j) of the RTI Act that pertains to Personal Information. In its original form, Section 8(1) (j) of the RTI Act 2005 clearly provided for withholding Personal Information which doesn’t pertain to a public activity or public interest or which amounts to invasion of privacy 👉So what kind of information can RTI now possibly deny? • Names and amount of billionaire wilful defaulters? • Wilful defaulters who have fled India? • How much loan has been waived off for the crony capitalists by banks? • How many work days have been given under MGNREGA? • How much grain has been distributed under PDS and to whom? • Whose names have been added or deleted from electoral rolls? • Income and assets of public representatives, bureaucrats and judges? • Beneficiaries of govt schemes? 👉Does Transparency compromise Privacy? • No. In a constitutional democracy like ours transparency and privacy are not mutually exclusive but they mutually coexist to ensure various fundamental rights 👉Citizens or Subjects? • The dilution of the RTI Act, 2005 under the DPDP Act, 2023 is a direct attack on both transparency and accountability which threatens the fundamental right to information.
