"The Court today takes the extraordinary step of holding facially unconstitutional the President's Order excluding from citizenship the children of foreign temporary visitors and illegal aliens," Thomas wrote. The framers meant birthright citizenship for the children of freed slaves. “Subject to the jurisdiction” has teeth. It means allegiance to the United States. Ambassadors’ kids born here? No citizenship. Invading armies’ kids born here? No citizenship. American Indians did not fall under U.S. jurisdiction for this clause. Congress granted citizenship by statute. Roe v Wade does not equal Brirthright Citizenship in terms of emotional investment. The lack of fencing around SCOTUS doesn't really mean anything about tomorrow's birthright citizenship decision. People are citing the lack of Roe v. Wade fencing as an indicator the court will uphold birthright citizenship. But the two cases are apples and oranges when it comes to the fervor of public opinion surrounding them. This morning, NOBODY was there demonstrating in favor of birthright citizenship. Its just not something people are set to riot over.

Interesting segment from today’s hearing on the birthright citizenship debate at SCOTUS: Justice Kagan arguing that birthright citizenship could logically exclude children of “sojourners” born on US soil because the nature of their visit to the US was never intended to be permanent. But the exclusion would not apply to the children of illegal aliens, presumably because when the illegal aliens illegally entered the country, their intention was to stay permanently, so their children born on US soil should be given citizenship. Interesting distinction that would effectively ratify the consequences of illegal conduct. Not convinced that’s what the Framers had in mind.
