They eventually box her car in and three agents jump out of the vehicle in front of her… with their guns drawn… screaming at her to get out of the car. She refuses, and states her rights. The agents open her car door anyway, drag her out, force her to the ground, and handcuff her. This is all happening while she is unarmed, and alone on a country road. She suffers cuts, scrapes, and bruises as they pin her down. Her husband then arrives and starts recording. He tells them they don’t have a warrant and cannot search her car. An ICE agent dismisses him outright and says, “I’m not getting into the legality of everything.” Read that again. A federal agent, pointing guns at civilians, openly says they are not concerned with legality. ICE puts this woman into their vehicle and starts driving her toward the Twin Cities, toward a federal detention facility… even though she is a U.S. citizen. About twenty minutes into the drive, they suddenly turn around after getting a call from a supervisor. The St. Peter police chief stepped in. After her husband contacted an attorney and spoke with the police chief, the chief identified the vehicle ICE was using, took custody of the woman, and personally drove her home. ICE turned her over to local police because what they were doing was so clearly wrong. This is what is happening in America. A small-town police chief had to intervene to stop federal agents from disappearing an unarmed woman for observing them. If ICE feels comfortable pulling guns on unarmed citizens in small towns, chasing them, throwing them to the ground, and ignoring the law entirely, then no town is too small and no one is safe from ICE brutality. A U.S. citizen responds: “We aren’t doing anything illegal. It’s totally legal to follow you.” He is correct. The First Amendment protects the right to record law enforcement, and federal agents, carrying out their duties in public. And federal regulations specifically recognize that people can record publicly accessible federal activity from public sidewalks, and streets, when they aren’t impeding or disrupting operations. Then, the agent says: “Stop following us, you aren’t going to like the outcome.” That is a serious First Amendment retaliation issue. And then it gets even more dangerous. The same armed federal agents, who just threatened these people with weapons and retaliation… surround the citizens’ car and claim THEY are blocking traffic. But look at the video. The only people blocking traffic are the ICE agents… who have now boxed in the citizens’ car. Agents cannot detain someone because they don’t like being watched. A vehicle stop requires reasonable suspicion of an actual legal violation. And recording and observing ICE agents, from a public place, is not obstruction. It is not illegal. She asks why they need her ID. They tell her they have a “target” who lives at the address. So she asks, “Who is the target?” An agent responds, “We have to make sure you aren’t our target,” then immediately asks, “Do you live at this address?” She says yes. The person filming points out the obvious and tells her she should call 911, because she already stated she’s a citizen and ICE has no jurisdiction over U.S. citizens. That’s when the agent says, “She never said she was a citizen. Calm down.” The woman corrects him. In the video, ICE agents are arresting a man while people film the arrest. A person tries to get information from the man, when an ICE agent suddenly moves toward her and another woman, pushes them back, while pointing an expandable baton at them, in a threatening manner. One woman tells the agent that she has a right to record… which he responds by shoving her. The agent then threatens the person filming, pointing his baton at them, and yells, “don’t follow me.” As if simply observing law enforcement is a crime… especially when there’s a clear physical barrier separating them. The First Amendment protects the right to record law enforcement in public. People filming, and not physically interfering, are exercising protected speech. The Fourth Amendment protects against unreasonable seizures and excessive force. Physical pushing and threatening citizens with a baton, when they are not resisting or obstructing, raises serious questions about whether force is being used lawfully, or as intimidation. Excessive force standards, used by federal law enforcement, requires any force to be objectively reasonable based on an actual threat or interference… not simply the presence of people recording, or criticizing them. So, once again… Filming and observing is not interference. Standing in public is not a threat. And this is not about “respecting authority.” It’s about whether constitutional rights still apply when citizens are watching government agents do their jobs.

In the video, Alley Henny, a Black chaplain, is standing with her back against a parked car while recording. An ICE agent is already pushing her backward as she simply asks: “What did he do?” But here’s what makes this situation even more disturbing… The man had already been detained… He was already INSIDE the ICE vehicle. The arrest was over. That means, there was no active arrest taking place for her to “interfere with.” Yet, multiple agents surrounded her anyway. One agent yells, “Get back! We have a warrant for his arrest. Get out of here.” She responds, “This is my neighborhood.” The agent’s response? “I don’t care.” Then, while she’s already backed against a car, and surrounded by TWO agents… a THIRD agent rushes over, grabs her, and forcefully shoves her down the street while screaming, “GET BACK! I ALREADY TOLD YOU ONCE!” And just to be clear… She wasn’t stopping an arrest. She wasn’t obstructing agents from reaching a suspect. She wasn’t preventing agents from taking someone into custody. The suspect was ALREADY IN THE VEHICLE. So, this entire situation raises serious concerns about excessive force and retaliation against protected speech. In the video, you can hear an agent approach a person sitting quietly in their car and announce that he is ICE, and that other ICE agents are also in the parking lot… Then the agent immediately issues what he calls his “one and only warning.” The person responds, “I was just on the phone.” The agent responds, “No. No you’re not.” The agent then escalates to a direct threat of violence, saying… “This is your one and only warning. I catch you here again, I’m yanking you out of that fucking car because you’re taking pictures on your little GoPro.” So, to be clear… a U.S. citizen is being threatened with assault not for impeding, not for interfering, not for committing any crime… …but for having a dash cam. The agent then adds, “If anything happens to our vehicles, or anybody in here, I’m coming straight for you.” Then more threats… “I will yank you out of that fucking car, and I will fucking put charges on you.” Charges for what? He never says. Because there are none. And then he admits the quiet part out loud… “I’ll put you in the fucking domestic terrorists app.” A federal agent threatening to label a U.S. citizen a “domestic terrorist” for sitting in a car while having a dash cam.
