Marimar Martinez, the Chicago woman whom a Border Patrol agent shot five times last year, says she was only at the hospital for three hours before agents rushed her out. She then was admitted to a second hospital because she was through from her bandages. "As we left the hospital, I was escorted out through the back in a wheelchair. I observed over dozens of border patrol agents waiting outside the hospital. One of them, one of the agents came up to me with his cell phone and took a photograph of me. It was the same agent who had previously kept coming in and out of my room, and I had to repeatedly tell him to leave. I told him I did not consent for him to photograph me, but he did not care. It still haunts me that this agent has my photo on his phone. Was this the agent that shot me? Was this a trophy for him?"

On October 23, Border Patrol Agents conducted enforcement operations near 27th and Whipple Ave. A large crowd of 75- 100 rioters surrounded law enforcement who set up a perimeter after agents were boxed in by a large box truck. Rioters then shot at agents with commercial artillery shell fireworks. A Border Patrol transport van carrying illegal aliens attempting to get to the safety of the perimeter was then attacked. Border Patrol agents were able to secure the van and get it into the perimeter. The mob of rioters grew more hostile and violent, advancing toward agents and began throwing rocks and other objects at agents, including one that struck Chief Greg Bovino in the head. Border Patrol agents repeated multiple warnings to back up and that chemical agents would be deployed if warnings were ignored. Riot control measures were deployed, including by Chief Bovino, and arrests were made. Agents properly used their training. The use of chemical munitions was conducted in full accordance with CBP policy and was necessary to ensure the safety of both law enforcement and the public.

DHS claimed agents were “boxed in by 10 cars” and that Martinez rammed them. Released surveillance and bodycam footage shows the opposite: no cars in front of Exum’s SUV, and Exum steering into Martinez’s car — not the other way around. His bodycam was off during the shooting itself, but audio picked him up afterward saying they hadn’t been shot at — they did the shooting. Then came the texts. To fellow agents: “I fired 5 rounds and she had 7 holes. Put that in your book boys.” One replied “good shootin lol.” Exum’s response: “Gracias Senor.” Four hours after the shooting — while Martinez was still in the hospital — then-Border Patrol Commander Gregory Bovino emailed Exum praising his “excellent service” and offering to extend his retirement.
