Minnesotans are peacefully exercising their First Amendment rights. What concerns me is ICE's policy of provocation. Reckless, unreasonable, and poorly trained ICE agents are escalating situations that don’t need to escalate. That’s exactly why this surge needs to end.

🚨This is one of the most disturbing ICE brutality videos I’ve seen in a long time… Another angle of this incident shows ICE agents suddenly rushing protesters outside the Newark ICE Facility, then continuously shoving U.S. citizens toward the wheels of a MOVING TRUCK… until an activist’s LEG is run over. And the most disturbing part? The protesters are not charging the agents… The agents are the ones creating the escalation. And not only that, they are forcing civilians backward toward a MOVING VEHICLE, escalating a situation that was not violent until THEY made it violent. That is reckless, dangerous force. So, let’s go over the obvious constitutional violations happening in this video… 1. First Amendment violations, because Americans have the constitutional right to peacefully protest the government. 2. Fourth Amendment violations, because federal agents cannot use excessive or objectively unreasonable force against nonviolent civilians. 3. Fifth Amendment due process concerns, because the government cannot arbitrarily target, intimidate, or assault citizens exercising protected rights. 4. 🚨BREAKING: New footage of Quakertown police choking a CHILD during an ICE protest. High school students walked out over federal immigration policy, which is protected under the First Amendment. And instead of de-escalating… instead of creating space and lowering the temperature like trained adults are supposed to do… police escalated. Video shows an officer with his hands around a teenage girl’s neck. These are minors. The people trained in use-of-force policy, the ones who claim they’re there to “maintain order,” are the ones using physical force on children who were peacefully protesting. Police are taught that in crowd situations their job is to de-escalate, especially with students. You don’t choke a kid and call it crowd control. You don’t put hands on a child’s throat and call it safety. That’s excessive force, it’s dangerous, and when it’s done in response to political protest, it becomes a constitutional issue. Students do not lose their rights because adults feel challenged. And what’s even more disturbing is that this isn’t isolated. 🚨Another day, another video of ICE/Border Patrol agents illegally detaining a U.S. citizen, in Escondido, CA. In the video, a group of masked agents racially profile and surround someone walking outside a building… demanding they prove their citizenship. And for those who don’t know… You do not have to “prove” your citizenship to federal agents just for existing in public. That’s not how the Constitution works. The Fourth Amendment protects you from unreasonable searches and seizures… which includes being stopped, surrounded, and interrogated without reasonable suspicion of a crime. And no… “you look like an immigrant” is not reasonable suspicion. That’s racial profiling. But, it gets worse… When the agents realize someone is watching, they move their truck to BLOCK the view. And everyone needs to ask themselves why? If everything they’re doing is legal… why are they hiding it? The person filming drives around to keep eyes on the situation… and points out that the agents don’t even have license plates on their truck… Then, the agents let the person go, because there was never a legal basis to detain them in the first place. That’s the part people need to understand… This isn’t “law enforcement.” This is intimidation… fishing for compliance… hoping people don’t know their rights. This is what it looks like when federal agents believe constitutional rights are optional. And once some lose their constitutional rights, we all do.

In the video, ICE agents walked up to a group of U.S. citizens while they were filming, on public property, and then started shoving them. Then, they escalated even further, pointing pepper spray at multiple people who were doing nothing but recording, before casually walking back to their cars and leaving. No additional arrests, no threat identified, no justification given… just force. So, let’s call this what it is… A violation of the First Amendment. You have a protected right to film law enforcement in public… These people weren’t interfering with anything… ICE agents approached them and retaliated against them for exercising that right. That’s unconstitutional. And then there’s the Fourth Amendment… Law enforcement cannot use force without justification. They cannot walk up to civilians, put hands on them, and escalate to threats of chemical force because they feel like it. 🚨BREAKING: ICE agents in New York illegally surrounded two cars and demanded the people inside prove their citizenship. Community members showed up and immediately started asking the questions ICE never wants asked on camera: “Do you have a warrant?” The agents claimed they did. But when people asked to actually SEE the warrant… they refused. Because they didn’t have one. That’s the constitutional violation right there. In the United States, federal agents cannot legally detain people, block their vehicles in, and demand proof of citizenship without lawful justification. The Fourth Amendment protects people from unreasonable searches and seizures. You don’t lose those rights because ICE decides to profile you. And unless agents have a judicial warrant signed by a judge, or actual legal probable cause tied to a crime, they cannot just trap people in their cars fishing for immigration status. ICE keeps counting on intimidation instead of law. They surround cars with multiple agents, act aggressive, throw around words like “warrant,” and hope people are too scared to question them. But the second community members demanded proof, the whole thing fell apart. Both cars were eventually released… because ICE never had the legal right to stop them in the first place. This is exactly why people recording matters. This is exactly why communities showing up matters. And this is exactly why constitutional rights matter… especially when federal agents are acting like they don’t apply to them anymore.
