Yet, where was this outrage when Jordan Neely, with over 40 arrests, was repeatedly released back onto the streets? Do we call that a “racial disparity”? What about criminals freed on minimal bail, only to endanger others again? Where is the outcry then? We heard accusations of “disproportionate use of force” against Daniel Penny. But Neely was alive when Penny released him, placed in a position of recovery. This dismantles the narrative of Penny as a ruthless “murderer” or “lyncher.” But what kind of force is acceptable when confronted by someone who is presenting himself as a threat, vocalizing his intent to harm, and actively coming at you? Penny acted to protect those on the train, and himself, restraining Neely under immense stress and imminent danger. Should Penny have waited, hoping for dialogue, while danger loomed?
