Not only should it not be controversial that I refuse to give myself powers that are not clearly stated in federal law, but that should absolutely be the standard, the constant of how an EPA Administrator approaches this position. Strictly adhere to the single best reading of the law pursuant to the U.S. Supreme Court decision in Loper Bright, and don’t ever get creative in trying to give myself any powers that the law hasn’t given me. If Congress wants me to do something other than the single best reading of the law, then they should try to change the law instead of demanding that I circumvent statute.

The Trump EPA will ALWAYS follow the best reading of the law, adhering strictly to recent landmark U.S. Supreme Court cases like Loper Bright. The Chevron Doctrine is DEAD. No longer can the EPA creatively interpret federal statute and implement new regulations with the claim, “the law doesn’t say I can’t so I guess that means I can.”

A panel of federal court judges just issued a stunning rebuke to the Roberts Court. They found that an Alabama congressional map green-lit by the Supreme Court intentionally discriminated against Black voters. That means the state will have to use a map with two majority Black districts this November, preserving a Democratic seat in the US House. And get this: the three-judge panel that rebuked the Supreme Court was made up of all Republican appointees.

Warnock on SCOTUS: First of all, no one elected this Court—to decide what kind of remedies we need in this moment. It’s really not up to the Supreme Court to say, “Well, we have reached the threshold where this issue around race and inclusion is no longer necessary.” That is not the job of the Court. And I’m struck, quite frankly, by the very easy and nonchalant way in which this extreme, activist Court knocks down precedent after precedent. The bar for doing that ought to be high, but we’re seeing with this Court—whether we’re talking about voting rights or a woman’s bodily autonomy, the right to decide with respect to her own body—they just strike down things they don’t like. They don’t have any respect, in the ways that we expect courts traditionally to, for precedent. And when precedents are torn down, you need a darn good reason to do it—and they are an activist court.

The New York Times reported on a private strategy discussion this weekend with Virginia House Democrats where they vented about the Virginia Supreme Court’s ruling tossing their new congressional map. One wild idea floated was lowering the justices’ retirement age to force them all off the court and pack it with new appointees. Nothing’s been acted on yet. It’s angry brainstorming right after a big loss. Democrats do feel they are above the law. If a Supreme Court ruling is unfavorable to them they try to find a way to replace the Supreme Court Justices on both State and Federal levels.

My Thoughts on the Colorado Supreme Court's 14th Amendment Case: First of all if I was on the Supreme court I would not have voted to remove Trump from the ballot. I think there are too many questions as to what constitutes an "Insurrection" and if Trump would have been culpable of such. With that said, to those who are blaming Democrats for this, you can all take note that the 6 people who brought this suit were Colorado voters, 4 of which are Republican and 2 who are unaffiliated. 0 were registered Democrats. The Colorado Supreme court didn't just wake up and decide one morning, "Let's ban Trump from the ballot". They took on a case brought by mainly Republicans and then made a decision after considerations. Now SCOTUS will likely have the final say, and I think that everyone, Democrat and Republican alike, should listen to what they have to say and how they rule. I support whatever decision they come to.
