Firing an employee for taking an unpaid 30-minute lunch break, while simultaneously demanding they work while eating at their desk, violates federal labor laws. If an employee is required to continue working or remain on duty while eating, the owner must compensate them for that time. An unpaid 30-minute (or longer) meal break requires the employee to be completely relieved of all job duties. They cannot be required to answer calls, work at their desk, or monitor emails. If the boss dictates that the employee must sit at their desk and continue working, that is considered "on-duty" time. This means the employee must be paid for that 30-minute period.
