News Release – Universal Ostrich Farms: Awaiting the Supreme Court of Canada Decision Edgewood, BC — October 31, 2025 As our family awaits the Supreme Court of Canada’s decision on November 6, we recognize that this moment extends far beyond one family farm in British Columbia. This ruling will help define how Canada treats its farmers, animals, and future agricultural innovation. Since the Court issued a stay order on September 24, the Canadian Food Inspection Agency (CFIA) has remained in custody of our ostriches. The purpose of that order was to protect the birds and preserve the status quo until the Court could decide. Yet the CFIA continues to present its occupation as operational authority — releasing statements that minimize the deteriorating welfare of the animals under its control. While the CFIA claims to be providing “feed, water, and bedding with veterinary oversight,” evidence and witness accounts show visible weight loss, stress, and insufficient nutrition and bedding. The feed being provided does not match the specialized diets that sustained this flock for decades. The Supreme Court order granted custody, not control, and with that comes a legal duty of care to maintain the animals’ health and safety — not to disrupt it. This upcoming decision is more than a case about ostriches. It marks a turning point for Canadian agriculture, science, and food security. Destroying healthy, immune-adapted animals in the name of outdated policy erases generations of genetic strength and antibody potential — resources that could protect humanity from future disease outbreaks. "Here is just a small sample of the earlier days of the RCMP and CFIA seizing our SEPARATELY OWNED property next door to Universal Ostrich Farms, which they then occupied for more than 50 days, while relentlessly circling us, harassing us with drones, forcing us to ask permission every single time we needed to go in or out of our own gate, and more. They were informed at every turn that this property was separately owned, and did not belong to the owners of Universal Ostrich Farm. They used a warrant that was nearly identical to the others, it named Karen and Dave, not the lawful property owners. We had to watch them completely take over the property on livestream, without ANY warning or paperwork of any sort from the CFIA or the RCMP. Even after we reached out to them, we still had ZERO contact from them until we were physically in front of them trying to get in to our own property. This concept is simple in my opinion. If you seize a person's property, that warrant better have that person's name on it. In an operation like this, you don't get to just also seize the neighbours property for good measure, calling it the neighbours "secondary quarantine property" That's just not how it works. We have never been able to locate or access the information used to obtain that warrant. We have seen nothing showing that this was anything more than them simply not doing their homework first on who owned the property. And when we repeatedly asked, all we were ever told was "I'm not discussing this with you." CFIA overreach accelerates as neighbour's property seized, threatened with arrest The CFIA has expanded its seizure of land to a family independent of Universal Ostrich Farms, restricting the owners from their own home and garden. In the latest twist of the Universal Ostrich Farms vs. Canadian Food Inspection Agency standoff, Rebel News is exposing how the CFIA’s overreach has expanded beyond the farmers and their avian-flu immune ostriches, and onto the property of their neighbours. While on site, we spoke with Alyson Turnbull, niece of ostrich farm co-owner Karen Espersen and cousin to farm spokesperson, Katie Pasitney. Turnbull explained her immediate families' shock and horror to come home to much of her mother’s land being seized for the CFIA cull mission while they were away from the home. The property, which borders the farmers' property, was never deemed a “dangerous zone” until this past September, just before the CFIA was granted a “warrant to search” under the Health of Animals Act, section 34. Despite not being involved in the ostrich farm operation, the family has been treated like criminals; RCMP remain stationed at their property around the clock while the Supreme Court deliberates whether the CFIA’s cull order can proceed. When Alyson tried to get answers as to why they were being restricted and told they can’t even harvest their own garlic, an RCMP officer told her that the CFIA “has control of your property” and that they were being “gracious enough” to allow them to access to the house only. She was later warned via text by a liaison officer to remember, that according to CFIA, Alyson could not go into her mom’s “property without first emailing them” and cautioned that the CFIA could order her arrest if she did not comply. The overreach mirrors the same heavy-handed approach that Alyson’s aunt and cousin, Karen and Katie, faced when being arrested shortly after the CFIA descended to their properties, because the ostrich farmers insisted on humanely caring for their birds until the CFIA was lawfully able to cull them. A list of “Judgements to be rendered on leave applications” for this week do not list the “UoF vs CFIA” case, which means the cull will likely remain paused this week. Still, the CFIA shows no signs of backing off the land, returning care to the farmers, and spending less tax dollars in doing so to give the Supreme Court time to reserve judgement.

In a heartfelt interview with Rebel News, Universal Ostrich Farms co-owner Karen Espersen and her daughter, Katie Pasitney, share their deep connection to their exotic flock of 400 healthy ostriches — birds the Canadian Food Inspection Agency (CFIA) has pledged to cull without further notice to the farm. Beyond loving and caring for the birds like family, the farmers are gravely concerned that the state is jeopardizing vital scientific research involving the ostriches — research that includes extracting robust antibodies from ostrich eggs to explore their potential in defending against viruses such as COVID-19 and avian flu. "To bring something natural back to the animal sector and the human health factor — and that was the antibodies," said Pasitney. Despite mounting public and political pushback, the CFIA has confirmed it will proceed with culling the entire flock due to concerns over avian influenza, even though the ostriches are asymptomatic. The family emphasizes that the remaining birds appear to have developed natural immunity, making them invaluable to ongoing virus-prevention research. To document and report on these developments, arrangements have been made for me to remain on-site at the farm, embedded with the growing number of protestors camping out in a last-ditch effort to stop the cull.

The CFIA’s ostrich cull isn’t about health — it’s about control The Supreme Court of Canada just dismissed the case from Universal Ostrich Farm in BC — meaning the CFIA can now go ahead and kill hundreds of healthy ostriches that have been disease-free for over 270 days. Let that sink in. No symptoms. No deaths. No proof of active infection. But the CFIA refuses to retest and threatens massive fines if anyone else does. This isn’t about public safety anymore. It’s about control — and it shows just how much power the CFIA and, by extension, the federal government, have to destroy livelihoods without accountability. Their policies are decades out of date. They treat every exposure as a death sentence, even when the animals recover and build natural immunity. Meanwhile, migratory birds keep spreading avian flu every year — something no one can stop. If our only response is to “kill everything,” then what happens when it’s poultry next time? Or dairy herds? Or any other livestock sector? 'This is a kill mission': B.C. ostrich farmer gives update on CFIA's death pursuit against healthy flock Federal judge who paused the Canadian Food Inspection Agency’s cull order is replaced, as government lawyer scoffs at farmers’ “belief” in herd immunity. “There is a small subset of the population that holds certain beliefs about herd immunity.” That was the dismissive remark made by Department of Justice lawyer Eileen Jones during a recent case management conference, as the Canadian Food Inspection Agency (CFIA) presses forward with its attempt to slaughter 400 ostriches at Universal Ostrich Farms in Edgewood, British Columbia. For the farmers — who maintain that their ostriches have been symptom-free and have had natural immunity to the H5N1 avian flu for months, Jones’s statement was a chilling echo of Justin Trudeau's infamous “small fringe minority” comment aimed at Canadians who questioned government vaccine mandates. Katie Pasitney, one of the farmers behind the groundbreaking ostrich research farm, joined Rebel News once again to provide a detailed update on the CFIA’s unrelenting legal campaign, the farm’s mounting financial burden and a troubling shakeup in their judicial review case. The farm’s previous victory — a dramatic emergency injunction granted by Justice Battista just before the CFIA was set to kill the flock on February 1 — is now clouded in uncertainty, as Pasitney revealed during her latest interview with Rebel News that Battista has been removed from the case. Adding to the pressure, the farm has been under quarantine since December 30. “All of our farm’s ways and means of raising money have been shut off,” she explained, noting that the shutdown includes revenue from research partnerships and egg sales not for human consumption. Pasitney also announced a restructuring in the farmers' legal team. In addition to longtime counsel Michael Carter, the farm has brought on Lee Turner, a Kelowna-based lawyer known for representing COVID vaccine injury whistleblower Dr. Charles Hoffe. “We've been lucky now to have Michael Carter and Lee Turner as co-council and they're both helping our farm and all of us fight this fight,” said Pasitney. The dual-counsel approach has also allowed the farm to shift how they pay their legal fees moving forward, which is expected to cost tens of thousands of additional dollars. To date, the farmers have paid around $75,000 for the fight, thanks to support from crowdfunding. Pasitney says several case management conferences have taken place to try and reach a resolution, but their pleas for scientific testing to simply prove the flock is now immune have fallen on deaf ears. “Give us the opportunity to test our ostrich eggs that are being laid right now. Give us an opportunity to test our ostriches that are all happy and healthy right now. We can prove that they are not a public threat, that they have antibodies… that was met with complete deaf, just a deaf response,” she said. “They are not interested in testing these animals. It has become very clear that this is kill mission.” Pasitney believes the government’s priorities are skewed: This should be something that should be very interesting to the Canadian Food Inspection Agency, as well as it should be very important to us. It should be important to both sides. We could not have to spend them however much money of the government and the time to kill all of our animals if they're all happy with herd immunity, natural immunity, and robust antibodies. Paitney said the Department of Justice lawyer's characterization of them “a small subset of the world” that believes in herd immunity is alarming. “During the COVID-19 times, if when you go back and you look at all of their marketing, their marketing was on community immunity, which resembled herd immunity. If you get vaccinated, you can create community immunity and your immune system. They're using it when they want to, that's gonna benefit them.” A two-day judicial review hearing is now scheduled for April 15 and 16 at the Vancouver Law Courts. The farmers welcome public support at the courthouse and are asking anyone who attends to do so peacefully. “We stand for peace, and we stand for kindness. That's how we are meant to win this,” said Pasitney.

B.C. MLAs speak out about Canada's kill mission for healthy ostriches Elected officials visit Edgewood, B.C. ostrich farm to help apply public pressure against the Canadian Food Inspection Agency's senseless plan to cull a flock of healthy research birds. The political pushback against the federal government's plan to cull 400 healthy ostriches at a farm in Edgewood, British Columbia is growing and it’s coming from both sides of the political aisle. During a press release, B.C.'s socialist NDP premier, David Eby, recently stated the following about the Canadian Food Inspection Agency’s (CFIA) mission to slay the exotic animals: “The minister of agriculture and I think British Columbians are a little bit frustrated by the actions of this federal agency. We understand the importance of containing the bird flu and the important role that agency plays. What’s hard to watch is a lack of discretion and ability to evaluate case by case scenarios.” The CFIA claims the birds must be destroyed due to concerns over an avian flu result from two deceased carcasses tested with the controversial PCR test late last year. The farmers consistently argue that their flock is healthy and worth more to humanity alive than dead, since their antibody-rich eggs were being used in partnership with Japan for research they believe is close to finding a non-mRNA treatment to stabilize the threat of the avian flu. Despite no signs of illness for the flock of 400, who survived the sickness that passed though the herd months ago, the CFIA remains unwilling to test the flock for immunity — and despite clear public and scientific concern over the decision. Local MLA and cattle farmer Jordan Kealy became the first elected official to visit the farm and recently raised the issue in the legislature. “It’s not about money. It’s a way of life for them. They would way rather have their animals be alive than to be culled,” he told Rebel News on the farm site. In response to the growing political concern we are seeing about the senseless cull, Kealy said “we’re seeing that it makes a difference. If there is that added pressure from the public and from constituents, we can start to see the different avenues open up. And I think the biggest thing when it comes to the cull practice that’s being practiced by the CFIA — there are better methods out there.” “This isn’t a scenario where if these birds get culled it’s not just a matter of restocking and starting over again you’re destroying the farmers’ lives” lives he added. The CFIA’s refusal to test the birds and its threats informing the farmers they could be imprisoned if they do so themselves, has heightened suspicions and outrage over the agencies cull plans. Thousands of people across Canada have been sending pre-written complaint through to the agriculture minister and CFIA officials, many have donated to help the farm cover its ongoing legal pushback of the cull, and a rotating group of protesters from across the country have been camping at the farm in protest. Even the Regional District of Central Kootenay unanimously passed a motion blocking the CFIA from disposing of ostrich carcasses in the district unless the agency can prove the birds were sick. The CFIA remains unmoved, informing the CBC after the motion temporarily paused its plans that’s the agency “will begin the humane depopulation and disposal of birds at the infected premises with veterinary oversight. Operational plans and dates will not be shared with the public in advance.” BC Conservative MLA David Williams, representing Salmon Arm–Shuswap, expressed his frustration at the CFIA’s actions while visiting the farm. “I understand it’s important to protect poultry producers and livestock producers in the province because agriculture is very important to our province and to our economy, but in the same token I believe in humanity and I want to see the CFIA do the right thing.” “I understand they still want to go ahead with the cull and I’m an animal owner, I live on an acreage, and we have peacocks, we have chickens — so it’s actually meaningful to me on a personal level as well” he continued. Independent MLA Tara Armstrong (Kelowna–Lake Country–Coldstream) also visited the farm and called on more to take a stand: “This is a really big issue. We have to make sure that as people that are representing our constituents and the province are speaking out to matters that matter to the average British Columbian and this is one of those things.” She also drew attention to the hypocrisy of the federal agency’s rush to cull the healthy flock when they could be the key to keeping other farmed animals and even pets healthy too. “We know that these birds are very closely tied to some possible breakthroughs in terms of their natural immunity to the avian flu, so I think we need to look at that and we have to ask the question, you know, why is it such an initiative for the CFIA to cull healthy birds?” Armstrong posed.
