As is his prerogative, this is a political statement, not an objectively accurate legal assertion. There are problems with the Rooney Rule, but it's not plainly illegal to ensure that minority applicants are considered in the hiring process. It would be more plainly illegal to intentionally hire a minority candidate based on their minority status. Here, the numbers don't suggest that's what's happening. Minority candidates are still underrepresented among the positions covered by the Rooney Rule; that's not indicative of minority status getting dispositive weight.

The selection of folks to PLAY the game is largely merit-based. The selection of folks to COACH those players is not. The data supports both of these statements. The Rooney Rule's 22-year track record is more evidence of the problem than rebuttal to it.
