I believe the officer was definitely wrong. He should have tased the guy and stood on his face while the other cops beat him with rubber hoses. I could be wrong about the law, though.

i’m sorry but the man is 100% right. They must be able to articulate a specific crime before they can trespass a citizen from a public building. The officer refused to allow his subordinates to articulate their reason for a verbal trespass. The guy may be an asshole but he still has constitutional rights.

No, he wasn't right. Trespass was based on staff complaints of disturbance (kids' class) so, public buildings can ask disruptive ppl to leave without it being a "crime." That was legal and he was justified. The way he handled it was beautiful. Props to the officer for patience

He disrupt anything if you watch the full video. They saw him and made it a person mission for them. The laws clearly cover what this guy was doing and the cops dont know the trespassing laws enough when it comes to public property.

This guy is perfectly correct. However, they haven’t verbalized any disturbance that he was causing, you can’t just go by somebody in the building saying he’s disturbing, there has to be an incident, or you need to be able to articulate what the disturbance is exactly. Otherwise, get the fuck out of there.

I’m on the side of the protester here. Although we didn’t see whatever it was that happened, the officer, although very courteous and in control, consistently failed to answer the key question he was being asked and was consistently diverting, and so, from the outside, I thought the protestor had a valid point that the officer never answered.

The officer came as a supervisor, but his officers spoke with the instructor for the children that complained about this individual. He was filming children, and perhaps that was why she didn’t want him there, but he clearly was boisterous and disturbing the peace. It is the law that you can ask someone to leave a public space when an instructor has stated that he is disorderly or disturbing the peace. No crime needed to be committed for him to be removed from that area. The officer handled it beautifully and the loudmouth can take it in front of a judge.

If u knew the law it doesn't even MATTER if there was a crime committed. If there's someone in the building holding a convention, a class (which there was) and someone's disturbing the peace and asked to leave, then that person should leave; if not and the cops get involved, asked again and still refuses to leave, then a trespass notice is issued to them. That's the law in Oregon in which this takes place.

If you were any kind of smart you would know that anyone can make up anything and tell cops anything but when they go to court the camera speaks for itself. Number two state law Oregon does NOT nor does ANY state Law override the Constitution. Go study

Explain how laws override the Constitution?

The Constitution’s the foundation, but thr Constitution allows states to craft their own laws on stuff like public safety etc. that’s their police power amongst other statutes they adopt to run their state or city. Those statutes don’t step over the Constitution; they operate under it. Most states end up with near identical rules bc lawmakers just peek at neighbors, borrow what works, tweak it, and boom, goes into the code.
