BREAKING: ENOCH BURKE SAYS APPEAL OF HIS DISMISSAL SHOULD NOT PROCEED THIS SATURDAY Teacher Enoch Burke's appeal of his dismissal from Wilson's Hospital School is due to be heard by the Department of Education this Saturday, 13 December. Enoch Burke will speak in court tomorrow. He will argue that the Supreme Court must address the issue of conflicting Court of Appeal judgments in his case before the Department of Education hears his appeal. It is imperative in the interests of justice that this issue be resolved. A three-member division of the Court of Appeal today granted an order that Enoch Burke appear in person before them tomorrow at 2:30pm to apply that this hearing be postponed. There are conflicting judgments of the Court of Appeal regarding the critical question of why Enoch Burke was disciplined by Wilson's Hospital School. This is an extremely serious matter as the school’s Board of Management is relying heavily on a flawed judgment for Saturday's hearing. The Department of Education hearing should not proceed while this matter is unresolved. One judgment from 2023, written by Mr Justice John Edwards, contains the extraordinarily false assertion that "there is no evidence whatever" that Enoch Burke's suspension was because of his views on transgenderism or his refusal to comply with the principal's instruction to call a child "they". Mr Justice Edwards, on foot of this, stated that the constitutional rights to freedom of religion and freedom of conscience are "not engaged" i.e. not relevant to Enoch Burke's case. As stated previously, the Board of Management of Wilson’s Hospital School are relying heavily on this flawed judgment for Saturday's hearing. In a later Court of Appeal judgment in 2025, Ms Justice Mary Faherty ruled, on the contrary, that the principal's instruction is "a kernel" of the disciplinary proceedings against Enoch Burke. She stated: "In my view, any reasonable reader of the principal’s report would understand that the principal considered her overarching complaint against the appellant to fall under the heading of refusal to comply with a legitimate instruction resulting in serious consequences, as provided for in the Circular". Notwithstanding this, the second Court of Appeal did not correct the errors of the first Court of Appeal and was unwilling to state that the findings of Mr Justice John Edwards are wrong. In response, the Board had provided a new document, never seen before by Enoch Burke, which provided a new rationale for his purported dismissal. After serious objections from Enoch Burke, orally and in writing, the DAP admitted just last week that no reliance could be placed on this document. Last Friday, in a one-line letter to Mr Burke, the DAP stated that they were going to "reconvene" the hearing. This is merely an attempt to whitewash after grave concerns were raised by Enoch Burke. This Thursday 8th of January, in the High Court, Enoch Burke will seek an injunction halting delivery of the dismissal appeal result. He is entitled to a fair and unbiased hearing of his appeal. Today he was fined almost a quarter of a million euros by the Irish Courts. Enoch Burke won his Court of Appeal case last July against the make-up of the Disciplinary Appeal Panel appointed to hear the appeal of his dismissal from Wilson’s Hospital School. The panel had included Kieran Christie, the General Secretary of the ASTI and promoter of transgenderism. There is a major discrepancy between the recent Court of Appeal judgment (which ordered the removal of Kieran Christie) and the behaviour of the High Court today in continuing to uphold the lawfulness of Enoch Burke’s suspension. The Court of Appeal ruled that the principal’s “overarching complaint” against Enoch Burke was his refusal to comply with her instruction to address a child by a new name and the “they” pronoun. The Court of Appeal further ruled that “indisputably” the disciplinary authorities must assess the legitimacy of that instruction. The High Court has never assessed whether the principal’s instruction was legitimate. It has repeatedly refused to acknowledge the true basis for the disciplinary action against Enoch Burke and has never determined Enoch Burke’s claim that there has been a breach of his constitutional rights. Notwithstanding, it has purported to uphold the lawfulness of Enoch Burke’s suspension. In all of these matters the High Court is wholly at odds with the recent judgment of the Court of Appeal. Today Judge David Nolan refused to have regard to the findings of the Court of Appeal and threatened to find members of the Burke family in contempt of court for raising the issue. Judge David Nolan refused to allow Enoch Burke’s affidavit or submissions to be opened or addressed in court. This behaviour is extremely concerning. Judge David Nolan stated today he does not want to put Enoch Burke back in prison. In the same breath he has accused Enoch Burke of having “a perverted sense of justice”. The truth is that Judge David Nolan knows that the public is appalled and outraged at the perverted actions of the Irish Courts over the past three years as Enoch Burke has been repeatedly denied his constitutional rights, the very rights which Judge David Nolan and others have solemnly vowed to uphold. All of this would never have happened but for the silence of the Church. The Church has betrayed Christ and been silent. For the last three years Enoch Burke has been made a pariah and a scapegoat for refusing to affirm transgenderism. The ethos of Wilson’s Hospital School, a Church of Ireland school, is Christian. Its teaching is “God made them male and female”. ‘Bishop’ Patricia ‘Judas’ Storey, the Patron of Wilson’s Hospital School, has betrayed this ethos, as has Archbishop John ‘Judas’ McDowell. Enoch Burke stood up for the ethos of Wilson’s Hospital School in 2022 when Principal Niamh McShane instructed all students and staff to use the ‘they’ pronoun for a male student. He objected to this demand. Storey and McDowell were silent and agreed with corrupt judges who upheld Enoch Burke’s unlawful suspension. When you see these people in their pulpits, making their fair speeches, think of Enoch Burke - locked up for over 500 days, stripped of his salary and denied his constitutional rights. Do not be deceived. These so-called Church leaders are Judases who have betrayed Christ. Their silence has been the prime cause of this whole situation.

Supreme Court Dismisses David Mark's Application for Stay of Execution The Supreme Court has dismissed an application for stay of execution of an Appeal Court ruling that led to the decision of electoral body, INEC to derecognize the Senator David Mark leadership of the Action Democratic Congress, ADC. This dismissal by the Apex Court on Tuesday followed the withdrawal of the application by senator Mark's counsel Jibril Okutekpa, SAN. Okutekpa had informed the five-member apex court panel headed by Justice Lawal Garba that INEC's interpretation of the Court of Appeal decision on March 12 has made the party 'leaderless.' He says the 'injunctive order' for the aggrieved parties to maintain 'status quo antebellum' is the reason for the current leadership vacuum in the ADC. He prayed the court for urgent action in view of the time constraints in the lead up to next year's crucial polls. In its intervention, the apex court gave procedural directions to fast-track the process, including abridging time for filing briefs and responses, due to the time-sensitive nature of the matter, ahead of the 2027 elections. It scheduled the substantive hearing of the appeal for Tuesday, April 22, 2026. The original dispute stems from a suit by Nafiu-Bala Gombe (former Deputy National Chairman), who is challenging the legitimacy of Mark and Aregbesola’s leadership. INEC has withheld recognition of either faction pending court resolution of the leadership tussle. Gombe sought, among other things, to restrain Mark (as National Chairman), Rauf Aregbesola (as National Secretary), and others from parading as ADC leaders, and to stop INEC from recognizing them. On or around April 1, 2026, INEC removed Mark and Aregbesola's names from its portal as National Chairman and Secretary, citing the Appeal Court's "status quo" order and related correspondence.

It is the Chief Justice of the respective High Court who decides the roster, which judge will hear civil matters and which judge will hear criminal matters. Now here he says, ‘No, no, you change the judge.’ So the Chief Justice of the Delhi High Court says, ‘No, there is no reason to change the judge. We are not changing the judge.’ He goes to the Supreme Court and files a petition saying, ‘Change the judge.’ Now you see, this is a very, very dangerous trend, not only for the judicial system but for our democracy. Now here, if you don’t like the order, you’re not challenging the order, you’re challenging the judge. And that too, you’re publicly humiliating and embarrassing the judge, that is wrong. So the number of people who have signed this letter, they are former and present vice-chancellors, IPS officers, lawyers, senior advocates, bar members, the High Court Bar Association’s former president, secretary, everybody has signed this letter saying this is a wrong precedent. It undermines the status, it undermines the dignity of the judiciary. Judicial officers should be allowed to work without any political pressure, without any pressure tactics. This amounts to forum shopping and bench hunting. This should be discouraged, and this is criminal contempt of court because you are attributing motives to the judge. So we have requested the Chief Justice of India to suo motu initiate criminal contempt proceedings against this person."

Sean Ó Longáin and Jack Cleary resigned after Enoch Burke brought High Court proceedings revealing the panel’s appalling breaches of fair procedures. In the December appeal Enoch Burke was subjected to a panel that blocked cross-examination of witnesses from the school, privately solicited documentation from the school in advance of the hearing and abruptly ended the hearing without closing submissions and during the attempted cross-examination of Principal Niamh McShane. Today, in a naked and appalling abuse of power, Mr Justice Brian Cregan struck out these High Court proceedings against the DAP. He did this even though Geraldine O’Brien, a panel member and nominee from the Association of Secondary Teachers in Ireland (ASTI), has not resigned and remains on the DAP. Enoch Burke was dismissed from Wilson’s Hospital School after he refused to call a student by a new name and the “they” pronoun. He has since spent almost 600 days in Mountjoy Prison. The DAP was supposed to be the "embodiment" of fair procedures and natural justice, where "independent" and "impartial" decisionmakers would hear Enoch's appeal. Instead, it turned out to be an absolute caricature of justice where almost every rule of fair procedure was broken. Geraldine O'Brien's organisation, the ASTI, advises schools to "use the pronoun that a child wishes to be used". Ms O'Brien herself stated at the outset of the DAP hearing last December: “If I were instructed by my Principal to call a child whatever, I have to implement that instruction, I don’t make the instruction”. At the last Court hearing on 4 February, Judge Cregan admitted that while Geraldine O'Brien remained on the panel, Enoch Burke's case was not moot. Today - notwithstanding the fact that Ms O'Brien has not resigned and still sits on the DAP - Judge Cregan had a totally different view. The striking out of these proceedings is an abuse of power and wholly unlawful. Official Department of Education rules governing disciplinary processes are clear that an appointee to the DAP remains on the panel unless or until he or she resigns. Judge Cregan has gifted an illegal escape route to Geraldine O'Brien - not provided anywhere in the Department of Education rules - for her to simply "disappear" without tendering her resignation and therefore without any public accountability for her actions. Before the other two members of the DAP resigned two weeks ago, one of them — the Chairperson, Seán Ó Longáin — lied in an affidavit to the court. Today Enoch Burke made a formal application to Judge Cregan to refer this matter of alleged perjury to the Director of Public Prosecutions (DPP). The judge did not make any ruling on this application or even acknowledge it. Today's proceedings are a mockery of justice by a judge who is desperate to wrap up Enoch Burke's case in any old way regardless of what the law says. He has told the school to get a new DAP panel up and running urgently. This would be the third Disciplinary Appeal Panel. Enoch Burke has been denied his constitutional rights from the start by the Courts who are now trying to pass it on to the DAP which is not working out. Sin and treachery can’t be hidden easily.
