(January 20th 2023) Bibb County, Georgia - The convicted killer of a Mercer Law School student has lost his appeal. Stephen Mark McDaniel admitted to killing Lauren Giddings. Then 27 years old, Giddings was murdered and dismembered by McDaniel, a fellow law student, on June 26, 2011. Days later, her torso was discovered behind Barrister's Hall, an apartment complex popular with law students on Mulberry St. A WGXA reporter at the time was the first to inform McDaniel that part of Giddings' body had been recovered. McDaniel was arrested shortly after and charged with her murder. He pleaded guilty to her killing in 2014 without going to trial and is serving a life sentence with the possibility of parole at Hancock State Prison. McDaniel's latest appeal was filed in the Middle District of Georgia on June 1, 2022, again alleging ineffective counsel and the theft of defense trial preparations by the state. He also claims that his defense attorneys -- Floyd Buford, Jr. and Franklin Hogue -- knew of the theft and didn't intervene. In his appeal, McDaniel, now 37, said, "Because of Defense Attorneys' incompetence and misadvice, Petitioner as deprived of the dismissal of his Indictment and given a Life sentence due to an invalid plea caused by Ineffective Assistance of Counsel." He requested that the court vacate his conviction and plea, free him from prison, and bar any further prosecution against him relating to the case. In documents obtained by WGXA News, U.S. District Court Judge Marc T. Treadwell said McDaniel's appeal could not even be considered because he filed past the required deadline, stating it was, "over a year late." Treadwell's most recent order was filed on December 15, 2022. McDaniel has since filed another appeal, received by the U.S. District Court in Macon on January 17, 2023. Full Article:
