The Smith Act wasn’t about stopping violence. It was about stopping legitimacy. it didn’t ban guns. It banned the idea behind them. You could still own arms, you just couldn’t talk about using them against tyranny, organize around resistance, or teach the theory of removing a corrupt government. The 2nd Amendment protects the means. The Smith Act criminalized the purpose. Rebellion became “subversion,” belief became evidence, and speech became intent. You don’t have to repeal the Constitution if you criminalize the thought that gives it meaning. The smith act was made to Prevent citizens from being able to remove corrupt governments .
