There is no such thing as a "minor" constitutional problem. Attorney General Andrea Campbell now appears to be acknowledging that her office knew the rent control ballot question had a problem tied to religion, but dismissed it as "minor" and certified it anyway. The SJC saw it differently. On... Tuesday, the Court removed the rent control question from the ballot because the religious housing exemption meant the proposal could not legally proceed. That should raise serious questions. The Attorney General is not supposed to be a cheerleader for certain ballot questions. Her office is supposed to be the legal gatekeeper. That means protecting the integrity of the process before campaigns, voters, donors, volunteers, and taxpayers spend months fighting over a question that never should have been cleared in the first place. Instead, Campbell’s office let a constitutionally defective question move forward, only for the Court to stop it later. This comes just days after the SJC tossed the income tax cut question because Campbell’s office failed to write a fair summary. It appears that Thomas Lukaszuk is now regretting his formation of the question in HIS citizen led petition. Apparently he is now back peddling and only wants it to go to legislation. Not a vote. Regardless, it LOOKS like, no matter what, the question of “should Alberta remain in Canada” will be on the ballot in the referendum. Thanks Tommy! 😁

On February 19th Robert Cosgrove stated in open Court, that although the CW had a 3 day window to appeal Judge Crup's order to return Karen Read's 2 iPhones, he did not do so, instead filing to Stay the order pending the MA Supreme Judicial Courts ruling in the Diaz. July 27, 2025 appeals court heard arguments and AGREED that a defendant's phone was held unsearched for 123 days before a search warrant was sought and executed. Since the appeals court agreed, that is the standing law. At the SJC, the CW is claiming once lawfully seized, the owners possessory right (control over the physical item) is altered until trial anyway. Therefore, they claim a delay in getting a warrant does not cause extra harm. But that is not currently the law. This court is in violation by allowing Cosgrove to hold the phones awaiting POTENTIAL overturn of current law by the SJC. This should be sent to SJC for potential review as directly violating the Appeals Court precedent. And since no appeal was in fact filed, the phones should be returned.

Two cases which were brought before the Constitutional Court of Zimbabwe challenging Constitutional Amendment Bill No. 3 (CAB 3) have been struck off, NOT dismissed. CAB 3, which seeks, among other things, to extend President Emmerson Mnangagwa’s term of office and change the method of electing a president from direct election by citizens to election by Parliament, requires two referendums in law, but the ZANUPF faction sponsoring it wants to avoid a referendum. The Constitutional Court struck both cases off the roll this morning. It is important to understand that the cases were not dismissed on their merits. Rather, the Court held that the issues raised could not originate and be determined solely by the Constitutional Court and should first be ventilated in another forum, High Court. Professor Lovemore Maduku, who is arguing the cases, has indicated that they will now proceed to the High Court. Should the applicants fail to obtain the relief they seek there, the matters will inevitably return to the Constitutional Court on appeal. Many lawyers have described the Constitutional Court’s decision as an example of constitutional avoidance. In their view, the Court has declined to confront what has become a highly contentious constitutional question, preferring instead to defer consideration of the substantive issues. A central argument in the war veterans’ challenge, led by Professor Madhuku, is that Constitutional Amendment Bill No. 3 was discussed and approved by Cabinet, which included President Mnangagwa, the two Vice Presidents, and Cabinet ministers. Charles Kanjama on whether the DP can run for office or not: The court was not clear on it; it could have been clear by making a declaration that the outcome of the impeachment will not have any consequence. My interpretation is that because the court has found that there has been a violation of the right to a fair hearing, of necessity, the fruits of the impeachment cannot all be sustained. The finality in terms of bringing in a new DP has been sustained, but the other fruits of impeachment, which is to stop the DP from running again, cannot be sustained. The outcome is fairly confusing #CitizenMondayReport

The Office of the Utah Attorney General office concealed a criminal investigation into Governor Cox’s nomination petitions. A whistleblower leaked us the document they were hiding which Michael Clara specifically had asked for via GRAMA in the summer 2024 and to which the Office of the Utah Attorney General refused to acknowledge its existence. The Office of the Utah Attorney General’s deception and delay critically undermined Just Phil Lyman and my efforts to challenge the 2024 gubernatorial primary election. This is not acceptable. The intent of the Rule 60(b) motion is to now force the Office of the Utah Attorney General to answer for this delay and deception in court. Rule 60(b) motion scheduled for Tuesday, January 27, 2026.
