@quizzycat99 Yes it is since SD has “adverse possession” law. If the fence has been in place and the taxes paid for 10 years the property is theirs. Something else is afloat!

In South Dakota, adverse possession claims require 20 years of continuous and uninterrupted possession of the property. The doctrine of adverse possession allows a person who is not the legal property owner to occupy the land without the owner's permission.

This certainly sount absolutely preposterous. This highlights the need to purge our government of people who abuse their power to harass the public. The perpetrators are the government employees.m and they should be forced to appear in court and account for their actions. Unfortunately it’s going to take some time to purge the system of evil bureaucrats.

This issue will likely be settled amicably between the government and this family. But that will cost the family a lot of money to go through the proper process with the lawyers. The government pays their lawyers with the tax payers money and and the ranchers will likely be in a hole that they will never be able to dig themselves out of. In the end, will probably lose the ranch.

Typically if there's a fence in place then after a certain number of years (10 I think) the fenced line becomes the property line irregardless of the land survey results.
