Today marks a significant win. His Honour carefully considered every argument raised at the last hearing and has now issued a 17 page written decision, publicly published to set precedent. Critically, the ruling makes it clear that the prosecution must prove, beyond reasonable doubt, that our words were intended... to offend. They were not. Our words were, and remain, an act of protest. A stand for justice, equality, and freedom. A call to bring attention to the atrocities being committed, not an attempt to vilify or demean. If some choose to be offended by the pursuit of justice or by standing against oppression, that speaks to their own conscience, not our intent or our humanity. The case continues, but today’s decision reinforces what we have said from the beginning. Truth matters. Intent matters. And the law matters. I saw this video, and I felt for this woman. To go through a case and court trauma for 13 years, not being able to work or travel, and be declared not guilty after that is ruinous. As a lawyer, I think many people are being ruined by the justice system, starting with a poor police investigation, the decision to be charged, and being convicted or released. We may have an opinion about a particular person or case, but we are not necessarily right. She felt it, and she knows it. Our justice system literally ruined her and many others.

Speaking in the Chamber today on the Official Secrets Act, I raised deep concern over the decision to drop charges against two individuals accused of espionage for China. As someone sanctioned and targeted by the Chinese Government, I was briefed at the outset that this was a “slam-dunk” prosecution — they were clear that they had met every single requirement within the Official Secrets Act about passing secure information to the Chinese intelligence agency that would be “directly or indirectly" useful to the Chinese state. That is very clear. It cannot, therefore, be for a lack of evidence that this has been dropped by the CPS, so why has the case been abandoned? The issue lies in how the Act defines an “enemy”. After the China audit, the Labour Government had the chance to put China in the same upper tier as Russia, North Korea and Iran — but chose not to. Ministers call China a “challenge”, not a threat. That position is indefensible. The Minister speaks of threats, but he does not say that China is a threat; he says it is a “challenge”, which is a ludicrous position to take. This decision has let down Parliament and, indeed, Mr Speaker himself, who stood up for Members targeted by Beijing. Until China is recognised for what it is — a persistent threat to individuals and states — our national security will remain compromised, and our reputation weakened as a strong state against terrorism.

The diktat from the Bangla Birodhi Zamindars that MPs cannot say ‘Jai Hind’ or even ‘Vande Mataram’ in Parliament is an attack on the very soul of our democracy. ‘Vande Mataram’ is our national song. ‘Jai Hind’ is the slogan of every Indian. These are not empty words; they were the cries of those who fought and sacrificed for our freedom. To try and erase them is to try and erase our history. Many have asked me to stop tagging them and to remove tweets about the Arizona Supreme Court and State Bar of Arizona's participation in a misinformation board created in 2019 at the urging of the Central Intelligence Agency and Department of Justice. I say to remain silent while our government clothes a lie in the truth is to do violence to those who hear the lie. In their anti-Trump fervor, they have raped and beaten near death my first true love, lady justice. Attorneys need to have this debate for lady justice stands blind holding her scales waiting for both sides (not just one) to poor in their evidence. By participating in a misinformation board absent an actual case or controversy, the judicial system in the State of Arizona, whether by written law, rule, or implication, has done an injustice to our profession, politicized itself, and harmed those we portend to represent. The proper role for a court is to resolve cases and controversies and not shape our speech to meet the needs of an out-of-control federal bureaucracy hell bent on eliminating the man trying to reign it in. If we as attorneys are afraid to speak about such matters of import to our profession and our clients, we are not attorney so much as cogs in an autocratic machine. Those of you saying we must eliminate Trump to save our system of government are destroying that very system of government. We should always remember that we are just layers on an onion with varying beliefs about the openness of free speech. If we have learned anything from history and the likes of Aleksandr Solzhenitsyn, it should be that once they have peeled my layer of the onion, yours will be peeled next.

We want to begin by saying something very clearly. This weekend, at the NCCM & Islamic Relief Canada gala, the Mayor of Canada’s largest city, stood with us and spoke the truth: that what is happening in Gaza is a genocide. That truth matters. It matters to the mothers who have buried their children. It matters to those who have been silenced and vilified for saying what is obvious to anyone with eyes and conscience. And it matters to every Canadian who still believes that moral courage must guide public life. Mayor Chow’s words tonight were not about politics — they were about acknowledging the genocide in Gaza, and the path forward. It is an acknowledgment that has important policy implications, as we all know, because as well also all know, there are far too many who have not made this acknowledgment. Mayor Chow’s words tonight make it clear that recognizing genocide for what it is the only ethical imperative. The standard should be speaking the truth. What is happening is a genocide. The time where everybody had to sit around and pretend that what wasn’t happening wasn’t happening has passed. We don’t need to be bullied and cowed. That time is over, and it was over years ago. Speaking the truth is the only way to be decent right now. Everyone - and that includes our politicians - must speak the truth. As the Mayor also reminded us, there is still much wrong here in Toronto. And we’ve seen terrible things happen to shut down peaceful protests to stand against the genocide in Toronto over the past few years. There are communities who do not feel safe. There are systems that must be rebuilt. There is work that lies ahead. That is why NCCM exists. To call for justice in Gaza, and also justice everywhere in Canada. To challenge hate wherever it lives. In policy, in policing, in silence. To remind this country that our values mean nothing unless they apply to everyone.

In the midst of the alleged coup plot, whether true or not, it is clear that some military officers have been arrested. What matters now is that we demand a fair, open, and transparent process. Nigeria has seen far too many secret trials and politically motivated accusations of coup plots in the past. If justice is to mean anything, the public deserves the truth, not another show of force or scapegoating. Let the facts speak openly, let every accused person have access to legal counsel, and let the process restore faith, not fear, in the rule of law.

This is abhorrent behaviour. Netanyahu is a wanted war criminal, indicted by the International Criminal Court. He should be immediately arrested by any country that purports to support international law. The fact that any politician, or party in Australia or elsewhere would indicate they would not follow through on their obligations under international law is extremely disturbing. It places every Australian at risk as it undermines the very system of rules that underpins our rights including basics like consular protection abroad, human rights protections, aside from basic sovereignty and territorial integrity without which the world is lawless. Australia is obligated under the treaties we have signed to support the independence and rulings of the international justice system which includes the duty to prevent genocide where sufficient evidence exists to invoke that duty, and to end apartheid where legally established by the ICJ. This requires sanctions and all measures to bring it to an end. Our duties are very clear. They do not change according to the case, the State, the individual or any other factor. Netanyahu is a wanted war criminal. And Australia should deliver him to The Hague. As we would any other. Being committed to the arrest of Putin, Duterte or Netanyahu is not a reflection of Australia’s regard or otherwise for our local communities, and should never be characterised as such for political gain, but of our unwavering commitment to justice under the international law established with our direct and proud involvement, and on which our future relies.
