On November 7, 2025, NDP MP Leah Gazan defended her push to criminalize so-called residential school “denialism.” Her original Bill C-413 did not pass. Then she came back with Bill C-254. B.C. law society settles libel suit over 'residential school denialism' claims A British Columbia lawyer who challenged his own governing body over false claims tied to the Kamloops residential school narrative has reached a confidential settlement with the Law Society of British Columbia, and in today's climate, that's no small victory. In 2025, Victoria criminal defence lawyer Jim Heller sued the law society for defamation after it published a link to statements from the First Nations Justice Council alleging that a resolution he and fellow lawyer Mark Berry introduced was "racist" and promoted "residential school genocide and denialism." The resolution itself simply asked the law society to correct its mandatory Indigenous intercultural course, which repeated widely circulated false claim that in 2021 the bodies of 215 children had been discovered at the former Kamloops Indian Residential School. To date, however, no human remains have been excavated or confirmed at the site, and the Tk'emlúps te Secwépemc has not announced any excavation confirming that what they now refer to as “200 anomalies” are graves. Heller argued the course should instead refer to the findings factually as "potential graves.” Rather than embracing that correction, the law society publicly condemned Heller's resolution and amplified statements from the First Nations Justice Council characterizing it as racist and an act of residential school denialism. The case has now ended in a confidential settlement, and the law society has removed its original statement concerning Heller, revised its course materials, and published what it describes as a "clarification” statement about not intending to defame Mr. Heller. In my interview with Jim Heller, we discuss why he chose to challenge the law society, how he feels about the David and Goliath type battle being over and the continued political pressure to criminalize the speech of so-called “residential school denialism". Federal Indigenous spending tripled from ~$11B in 2015 to over $32B annually by 2025. Since 2014, nearly a quarter of a TRILLION dollars has been spent on Indigenous priorities. $243 Billion. Since the Liberals PAUSED First Nations Financial Transparency Act enforcement in 2015, there have been no penalties for non-disclosure. Some First Nations have never filed or submitted an audit, others haven’t in over a decade. Meanwhile, First Nations life expectancy plummeted. In BC: it dropped 7.1 years (2015-2021), in Alberta, it’s down 7 years since 2015; now 19-year gap vs non-Indigenous. The opioid crisis hit reserves hardest, reversing prior gains. We have tens of billions poured in, accountability paused and yet outcomes are worse. In addition to all of this spending, we are allowing major land claims, to which most of BC is subject to. ALL OF KAMLOOPS, is under a land claim. The courts allow for oral evidence to be submitted without any other proof. And oral evidence is equally weighted as physical evidence based on historical claims from ancestors. And despite millions spent looking for mass graves, not a single one has been found, but when this is raised, Chiefs call for the resignation of politicians. Canadians deserve truth, transparency and accountability. We also deserve to not lose title to our homes and this era of secrecy, land claims and countless tens of billions of tax dollars going to a particular race for land claims based on oral testimony because, ancestor’s used to hunt and fish there. It all needs to end. It’s not sustainable.

Today I went to see a speech by Kim Murray, who released her final report about residential schools. Part of her focus was on what she calls “residential school denialism”. She defines denialism pretty broadly – it includes minimizing the harm of residential schools, saying the death rates were typical for the period, saying that we don’t know the truth, that there is a conspiracy to exaggerate deaths, and that it wasn’t a genocide. And Murray wants to criminalize this speech. This is a terrible idea. A lot is unknown, and creating a broad criminal sanction around this topic will not allow for an investigation to take place. Residential schools were a terrible policy, and to the extent that people want to minimize how bad it was, the stories Murray collected in her report are a better answer to that misunderstanding. Stories like experimentation on children, abuse, and disease. Those stories are the answer. Not criminalizing speech.

Trump was about to sign an Executive Order BANNING the burning of the American flag, with a penalty of ONE YEAR in prison for offenders. Trump made his point clear before signing: “Would you listen to this? This is very important. Flag burning—all over the country they’re burning flags. All over the world they burn the American flag.” Will Scharf detailed the order’s intent: “What the Executive Order does, sir, it charges your Department of Justice with investigating instances of flag burning.” “And then where there’s evidence of criminal activity, where prosecution wouldn’t fall afoul of the First Amendment and instructs the Department of Justice to prosecute those who are engaged in these instances of flag burning.” Then Trump doubled down on the consequences for those that burn the Stars and Stripes. The families of the children in the alleged mass grave at the Kamloops Residential school, asked for the bodies to be returned for a proper burial. So why would the Kamloops FN Chief ignore the request of the families, who were told their children, brothers & sisters were dumped in a mass grave? We were told specifically that 215 bodies of children were found. Children as young as 3 (See video). They didn't say maybe. They called it proof of genocide and then refused to criminally investigate it. That's 215 families living in grief, believing their loved ones are there. The Band was given over $12 million to respectfully remove the bodies. Either it's the largest crime scene in Canadian history and needs an actual criminal forensic investigation, or it's a lie. Either way, the families who were led to believe their loved ones are dumped in a septic field deserve answers, justice & closure. No loving family would want their loved ones left dumped in a mass grave in a septic field. The Robert Pickton farm had a forensic investigation for years. Many of his victims were former foster children & First Nations. The families wanted answers. It's time to either properly investigate this with the full powers of a criminal investigation, like with Robert Pickton, or stop claiming it happened.
