The grubby deal Fianna Fáil and Fine Gael struck with Michael Lowry involved the appointment of a record number of Super Junior Ministers. We had to see clarity from the courts on this. No one in political life should have the opportunity to play fast and loose with the Constitution in order to get the political outcomes that they desire. It matters that we have good governance. The Court has given a lengthy judgement today. We will consider it over Christmas and decide on our next steps. We will never stop challenging the stroke politics of Fianna Fáil and Fine Gael.

We are not changing the judge.’ He goes to the Supreme Court and files a petition saying, ‘Change the judge.’ Now you see, this is a very, very dangerous trend, not only for the judicial system but for our democracy. Now here, if you don’t like the order, you’re not challenging the order, you’re challenging the judge. And that too, you’re publicly humiliating and embarrassing the judge, that is wrong. So the number of people who have signed this letter, they are former and present vice-chancellors, IPS officers, lawyers, senior advocates, bar members, the High Court Bar Association’s former president, secretary, everybody has signed this letter saying this is a wrong precedent. It undermines the status, it undermines the dignity of the judiciary. Judicial officers should be allowed to work without any political pressure, without any pressure tactics. This amounts to forum shopping and bench hunting. This should be discouraged, and this is criminal contempt of court because you are attributing motives to the judge. So we have requested the Chief Justice of India to suo motu initiate criminal contempt proceedings against this person."

The Supreme Court appealed to the Delhi High Court against the order of the Chief Information Commissioner. But the Delhi High Court said, "You have to release the information." So the Supreme Court appealed the decision of the Delhi High Court to a 2-judge bench of the Delhi High Court. The 2-judge bench of the Delhi High Court referred the matter back to the Supreme Court, saying this is your matter, you decide. Now the Supreme Court became the judge, jury and executioner in its own case. Cricket bookies would kill to have such a fixed match. A single-judge bench of the Supreme Court took up the matter and said a 3-judge bench should decide the case. The 3-judge bench of the Supreme Court sat on the case for 8 long years and arrived at a verdict - the matter should be looked at by a 5-judge bench of the Supreme Court. Finally in 2019, the 5-judge bench of the Supreme Court gave its verdict. It did not say that Supreme Court judges should declare their assets. It merely said the Supreme Court should release any information it had. So basically if a judge does not declare his assets, then there is nothing to declare. Comedy, yes. Funny, no.

There are also people who are deterred merely by being summoned to court and they will not repeat the act. Those who possess self respect, once they appear before the court, they will not repeat the act again. This shows that society is diverse, and laws are applied differently, according to people’s conditions and circumstances. Another important point is that these laws were not created by us, rather they are derived in detail from Hanafi jurisprudence. Question: it is possible that among ordinary people, what you refer to as the lower class, there are individuals who listen to advice and properly observe the law, perhaps even better than those from the elite. In such a case, that person can no longer be considered part of the lower class, but rises to a higher social standing. A “lower” person is someone who is a repeated offender, someone who has been caught stealing multiple times, has repeatedly committed wrongdoing, and has not been deterred. In such a case, the judge is obliged to consider the circumstances, and the extension of corruption cause by that person in society, based on that, order imprisonment. However, if the person is of high status, understand admonition, is a community leader, and possesses social credibility, it may be sufficient to inform him that he has committed the act, and that it must not be repeated.
