No matter what you write or agree about can trump the law. Section 8(1) of Act 120 of 1998 is clear about this. You cannot contract out of law. Rather divorce and be safe rather than rely on some agreement.

The most important part though is celebrating a marriage “in accordance with custom”. In most South African cultures, the groom is not even there during first negotiations. So having lunch after negotiations isn’t the celebration contemplated by the Act.
