The school districts etc are afraid of parents that have special needs etc suing them. So that causes situations such as this to happen OFTEN.

I hear ppl blaming the child but not the aide who was supposed to be watching said child I’ve worked with children and adults with special needs that’s why it’s called SPECIAL NEEDS I blame the school not the child it’s the school responsibly to protect both children in this case

The school district was negligent if they did not provide adequate supports and/or appropriate education setting for the special needs student, for the student's safety & for the safety of others. It is the school district's responsibility & it sounds like there are a few potential lawsuits there. Everybody lawyer up.

I could’ve told you that when it happened. Admin won’t move them. Or parents deny outplacement. The fact a 4th grad special needs child was even in a K class makes me think they are just dispersing him around.

The aide assigned to work with the child may have been neglectful, but the fact the child had done this before and wasn't removed from the building is due to state laws protecting those kids and which allows parents to challenge removing them to a different building/program.

I have 2 special needs children and if they ever have an outburst that jeopardizes another child then I will be removing them from the school to one that is full of trained staff for special needs children.

as a mom to a special needs teen, this breaks my heart. she has to be supervised. whoever did that to that poor child should sue the special needs teacher for not doing their job

I'm glad they are pressing charges, I remember in the comments in the first video that he said he didn't really want to. I hope all kids, including the one who hurt others, will be put to safety.

Unfortunately, kids with that sort of behavior are not placed in appropriate settings. Funding is limited, sadly.

Awful! Either the child should be expelled or a full-time aid assigned to watch their every move. This happened to my daughter in 02 and 03 by a child (the 2nd incident was SA!!) and that's what the school did, as well as making sure my daughter never saw this kid.
