That person can then sign an affidavit under penalty of perjury stating the child lives with them and they are acting as the caregiver. The affidavit does not require a parent’s signature or court approval. It grants that person legal authority to: Enroll the child in school Consent to medical, dental, and mental health treatment Providers (schools, doctors, etc.) who rely on the affidavit are protected from liability, even if the parent later objects — unless the provider had actual knowledge the affidavit was invalid.
