A US employer cannot just simply pay an H-1B worker $45K just because he is foreign. Indeed, the law requires employers to meet applicable wage requirements. BUT VANCE MAKES VALID POINTS TOO. There's evidence to suggest that H-1B system is misused to undercut wages. U.S. workers have been displaced. There's even an argument that the scheme has enabled labour-broker/visa fraud. There are also cases of employers exploiting the system rather than using it to recruit genuinely specialised talent. But the answer isn't to demonise H-1B workers. This is exactly why any company that does mass layoffs should be banned from hiring H-1Bs to replace them.
