AI labs are already regulated by existing laws: a cyberattack is a crime, whatever the tool used to do it. Apply those laws to these incidents. There was -at the very least- gross negligence. Do not fall into the regulatory capture trap!

No, data sets are all out there and so is the tech to build off them. Countries now are building from scratch where others are using open source as a base. And it isn't all LLMs but specific models so software won't be stopped. We are beyond that. Smart countries now will focus on chip manufacturing and such not just for AI but also for drone production. The reality is we can't regulate us out of this other than telling Anthropic or Open AI that if you do these sloppy experiments and they go wrong, you will be charged under are hacking laws. They are not obeying laws with their experiments or they are incompetent in what they are doing. There is where the regulation should be and it is already on the books.
