UPDATE ON TODAY’S PROCEEDINGS BEFORE THE SUPREME COURT OF NIGERIA ON ONYENDU MAZI NNAMDI KANU’S CASE: Onyendu Mazi Nnamdi Kanu’s case came up today for the scheduled hearing of the appeal. However, the hearing was stultified by the Federal Government's request for an extension of time, to enable them file their Reply brief. It will be recalled that during the proceedings of the 27th April, 2023, the Learned Presiding Justice of the Supreme Court gave the parties, timelines within which to file their respective briefs so that the hearing of the main appeal will go on today. But in their usual practice, the Federal Government started by filing a brief which was in excess of the threshold 40 pages allowed by the convention and practice of the Supreme Court. This fundamental error was promptly observed by our legal team ably led by the erudite man of letters and Senior Advocate of Nigeria, Prof. Mike Ozekhome, SAN, who immediately called the Learned Silk representing the FGN, and further wrote to the Attorney General, notifying them of the obvious anomaly; and requested them to take immediate steps to avoid anything capable of truncating the proceedings of today. On account of this correpsondence, the Federal Government filed another Appellant’s brief of 40 pages, and served on our team on Thursday, by which time they were clearly outside the time granted them by the Supreme Court to file the process. Notwithstanding this obvious shenanigans introduced by the Federal Government to frustrate today’s hearing, we promptly filed our Respondent's brief of argument and served same on them within the time allotted to us by the court. However, unfortunately, when the proceedings resumed this morning, the Federal Government applied for a short adjournment to enable them file their Reply Brief. This was a clear ploy to frustrate today’s hearing. It is indeed in the Federal Government’s DNA to file court processes late hours before the scheduled hearing in Onyendu's matters, at times, they will file and hide their court process from us. Our erudite Lead Counsel Prof. Mike Ozekome, SAN, however, strongly maintained relying on extant laws, that the appeal was ripe for hearing. He even proceeded to appeal to the court to even hear our motions particularly the one for the transfer of Onyendu to the Correctional Center pending the hearing of the appeal. It was part of his compelling submission that that Onyendu's health condition is worsening in the DSS' gulag where he's illegally held in solitary confinement. The Learned Justices of the Supreme Court, however, gave a comprehensive account of their tight schedule which may not even permit them to hear any of the applications today because they have constitional timelines within which to deliver a Ruling or Judgement, which they cannot meet up with if any of the applications is taken today. They eventually adjourned the matter to 14th September, 2023, for the hearing of the two appeals. It is to be emphasized that the Federal Government is employing every unprofessional methods to ensure that the hearing of the appeal is delayed so that Onyendu Mazi Nnamdi Kanu will be kept in solitary confinement indefinitely. The Federal Government was the party that filed the present appeal, but have shown total lack of diligence to prosecute same. However, I want to assure Umuchineke that justice can only be delayed but not denied, the Federal Government can only run but they can not hide. These institutions, which claim to represent justice, are actually demolishing the justice system. They were originally established to uphold justice, but they are now utterly failing. These judges have no integrity—whether it’s out of fear or because of rewards they may have received. The Pakistani judicial system has entirely collapsed, and in its place stands a rule of injustice. We have always made it clear that our struggle is for the implementation of justice. We demanded that missing persons be brought before the courts. Whatever the state is doing to the Baloch people should at least go through the legal system, there must be legality. But instead, the justice system itself is being weaponized against us as a tool of repression. This is not just injustice against us: it is a tragedy for the entire Pakistani judicial system. I just finished listening to Wike’s diatribe against former president Goodluck Ebele Jonathan, he took the former President to the gutters and didn't spare any derogatory works against his person. While I am tempted to say former President Jonathan deserves these malicious attacks from Wike… well, I'll say it, well deserved. When people like me were calling on him to tame Wike at the earliest stage of his public show of shame, GEJ stood aloof and played to the gallery. More so, he distanced himself from the affairs of the party and positioned himself as one who didn't have a stake in the party. The same party that he owned everything he is politically today. Look at Obama, the late Nelson Mandela, and the rest, they all stood tall by their political ideology cum parties in the interest of the greater good. Former President Goodluck Jonathan enjoys a massive appeal and love and commands the requisite respect that would have been of great value to the party. Alas, Wike, the same man they practically contributed to his political successes, in no small measure, has now come out to mess him up. He had the guts to demean former President Jonathan. Truth be told, in all ramifications of life, Wike cannot lace the shoes of GEJ, Atiku, Obi, and most of those he usually rants about on TV. He will never be president or vice president, he has hit the ceiling. Historically, people who toed this same part of Wike are presently running amok and living the life of jesters and have become examples of how not to live life. Nnamdi Kanu is trending because the IPOB agitator was spared a death sentence and slammed life imprisonment by Justice Omotosho over terrorism charges. He has 30-days to approach the court of appeal. On October 15th 2015, MNK was arrested upon arrival in Lagos from UK, on charges of treasonable felony. He wasn’t released until after 18months in detention, when he was granted bail on health grounds and released from Kuje prison, April 28th 2017. He later absconded after military raided his home in Abia. Until June 19th 2021 when he was arrested in Kenya. Then the case morphed from treason to terrorism. Due to his inciting broadcasts on several occasions between 2018 and 2021, when he was outside the country. Since then, he has been between DSS custody, courts and detentions battling 15 count charges of treason and terrorism allegations. April 2022, Justice Binta Nyako reduced the charges to 7 from 15, citing lack of substance. Specifically, she removed counts 6, 7, 9, 10, 11, 12, 13, and 14. Six months later in October, the Court of Appeal discarded the standing 7 charges and ordered his release. On grounds of the illegal capture and rendition to Nigeria from Kenya, which therefore invalidated FG’s charges. Which this June, a Kenyan High Court ordered he be paid Ksh 10million as compensation. FG kept him detained and immediately approached the Supreme Court who in December 2023, overturned the appellate courts judgement. Stating that, indeed his rendition was unfair and illegal but doesn’t affect the integrity of FG’s charges. His lawyers described it as; unconstitutional, per incuriam, and a travesty of justice. Arguing that, retrying after an acquittal is tainted, unlawful. Constituting double jeopardy which is prohibited by Section 36(9). Meaning the court had contradicted its own precedents, as the court of appeal’s judgement was supposed to be final. However, September 2024 Justice Binta recused herself from MNK’s case after he publicly expressed lack of confidence in her, as he believed she was compromised and bias. With this the case had to start again and rather swiftly. Justice Omotosho took over. And today November 20th, Justice Omotosho convicted and sentenced MNK on all 7 charges. Count 1,4,5 and 6 offense: Threatening and intimidating the public, inciting violence against security personnel and civilians. He advised students to make explosives to attack security operatives; terrorism. He was also accused of the EndSars destruction in Lagos. — These should carry death sentence, but the (court tempered mercy and passed life imprisonment.) Count 3 — Admiting to be a member and leader of IPOB, which is considered a terrorist organization. (He bagged 20yrs with no option of fine.) Count 7 (or 15) — He imported Tram 50L radio transmitter. (5yrs jail.) MNK argued that there is no law in Nigeria till date that deems importing a radio as a crime. All his objections were overruled. He won’t be kept in Kuje. But a private solitary confinement due to his explosive nature. There are 8 charges on paper. But some were merged, that’s why it looks like he wasn’t convicted on count-2 which is also intimidation and sit-at-home. MNK now has 30-days (could be extended) from today to appeal the judgement. Which could result to; reduced sentence, retrial, total acquittal, or sentence upholding. Nigerians are polarized, some argue that it’s a fair judgment. Others argue that, he was only charging his people to defend themselves from terrorists-Fulani’s and his utterance were just commentary with no ties to any violence.
