Polyak Madencilik is owned and operated by Qitaihe Longcoal Mining Co., Ltd., a Chinese mining enterprise affiliated with Heilongjiang Longmay Mining Holding Group, a Chinese state-owned mining conglomerate. Due to systematic violations of their lawful economic and social rights, 1,243 mine workers have halted production entirely in order to defend their livelihoods, safety, and dignity. This decision was not taken lightly. It represents a last resort in response to persistent and unresolved violations of fundamental labour rights. The workers have reported and documented the following violations: – Failure to pay wages fully and on time – Failure to implement wage increases and contractual entitlements – Failure to pay retroactive wage entitlements arising from collective agreements – Failure to provide lawful guarantees regarding severance and termination compensation – Failure to ensure safe and lawful working conditions – Failure to establish lawful and constructive dialogue with workers and their union As a result of these violations, workers have experienced severe economic hardship, insecurity, and serious occupational health and safety risks. The workers’ demands are clear, lawful, and reasonable: – Immediate and full payment of all outstanding wages – Full payment of all retroactive wage entitlements and benefits – Written guarantees ensuring lawful severance and termination compensation – Immediate implementation of all contractual wage adjustments – Immediate corrective measures to ensure occupational health and safety – Establishment of lawful and constructive dialogue with workers and their union These circumstances constitute serious violations of the Guidelines for Chinese Enterprises’ Overseas Social Responsibility Compliance (2025), issued by the Ministry of Commerce of the People’s Republic of China. In particular: Article 15 requires Chinese enterprises operating overseas to comply with host country labour laws and ensure workers’ lawful wages and benefits. Article 18 requires enterprises to ensure occupational health and safety. Article 19 requires enterprises to establish grievance mechanisms and properly resolve labour disputes. Article 32 requires enterprises to comply with legal and contractual obligations. Article 48 requires enterprises to take corrective measures where harm has occurred. These Guidelines clearly establish that Chinese enterprises operating overseas have a responsibility to respect workers’ lawful rights and to remedy violations where they occur. The failure of Qitaihe Longcoal Mining Co., Ltd. and its subsidiary Polyak Madencilik to comply with these standards raises serious concerns regarding compliance with Chinese government regulations and internationally recognized labour standards. Chinese overseas investments must not be built on the violation of workers’ rights, unsafe working conditions, or the denial of lawful wages. We call upon the Ministry of Commerce of the People’s Republic of China and the relevant Chinese authorities to review this situation and to ensure that Qitaihe Longcoal Mining Co., Ltd. complies fully with its legal and regulatory obligations. We are issuing this statement so that the voices and lawful concerns of the workers may be heard and so that this situation may be resolved in accordance with the principles of lawful, responsible, and accountable overseas investment.
