Reuters reported that Iran told intermediaries Lebanon must be included in any ceasefire arrangement, which is one of the clearest strategic indicators yet that Tehran sees Hezbollah’s position as inseparable from the end state it wants. On the ground, Hezbollah remained active. Jerusalem Post’s live coverage led with two injured after Hezbollah rocket fire in the north and referenced a missile near Hadera as part of the same broad war picture. Reuters also reported the U.S. proposal contains sweeping demands ranging from dismantling Iran’s nuclear program and curbing missiles to effectively handing over control of Hormuz, while Tehran is demanding guarantees, compensation, formal Strait control, and Lebanon’s inclusion. Iranian state television also carrying language that Tehran will end the war when it decides to do so and only on its own conditions showing the regime is posturing and why a quick off ramp still looks unlikely. On the Israeli side, the government approved a reserve call up ceiling of up to 400,000 reservists, according to Times of Israel. Those are not central operational developments for the war front, but they do show the political system continuing to harden in parallel with the regional conflict. ━━━━━━━━━━━━━━━━━━ *⃣ WHAT MATTERS MOST RIGHT NOW What changed in the last 24 hours is that the war kept widening sideways even as Iran’s direct military pressure on Israel looked less overwhelming than earlier phases. ➡️Inside Iran, the strike campaign remained broad, geographically dispersed, and increasingly focused on infrastructure that matters to long term war capacity. ➡️Against Israel, Tehran still showed it can threaten high value targets and generate fresh missile waves, but the pattern looks more episodic than dominant. ➡️In Lebanon, Hezbollah remained active and politically central to any prospective endgame. In the Gulf, the war’s economic and maritime dimension kept hardening, which may now be one of Tehran’s most important remaining pressure tools. ➡️And politically Tehran is not signaling real compromise. It is signaling defiance, maximalist conditions, and an attempt to preserve leverage through Hormuz and Hezbollah while absorbing continued military punishment. One of the claims I address in my new book, Israel on Trial, is the allegation that Israel has committed genocide. Genocide has a clear legal definition. It means that a country, not individual soldiers, a country has the specific intent to destroy an entire people in whole or in part as such, because they are that people, by killing their members or because of their racial, religious, or ethnic origins. The proponents of the genocide claim have to show that the Israeli government had the specific intent to wipe out the Palestinians of Gaza because they are Palestinians, not because there's Hamas fighters embedded within them, not because they're trying to release the hostages. That's why when you read, for example, the briefing book that the legal team from South Africa submitted at the International Court of Justice, there's no mention of Hamas really. There's barely a mention of October 7th. There's no hostages. It's a fictional world in which there are no hostages, there was no October 7th, there is no Hamas, and there's just Israeli war planes and an innocent civilian population. That starts to look a lot more like genocide if you remove all of the essential elements that are the reality on the ground. How do we begin to analyze this question? The first is historically. We know for example from the Nuremberg trials that this argument that Hamas and its supporters are advancing was already rejected by the original people who tried the original war crimes trial at Nuremberg. The German defense team wanted to advance the defense that you shouldn't be too angry with our people, and you shouldn't think that the prosecution has any moral right to be prosecuting and trying our defendants, because the pilots who were flying over Dresden and Berlin and Tokyo and Hiroshima are equally guilty of these war crimes. And the Nuremberg trials resoundingly rejected that theory and said, "You're not guilty of these war crimes when you're fighting a war of existential survival against a genocidal regime in a war that is defensive in origin, that you didn't start, and never wanted and frankly never expected." But it's much more than that. Israel has fought the most precise, and in some respects the most humane, urban warfare conflict the world has ever seen. And you don't have to take my word for it. Take the HLMG, the High Level Military Group. The HLMG is a collection of high-level officers and generals from almost every Western army in the world. Not Jews. Not Mossad agents. These are generals from America, from Canada, from New Zealand, who all went to Gaza, went to Israel, looked at the evidence, looked at Israel's strike packages, realized that Israel is fighting a war that is essentially run by lawyers. This doesn't appear in the newspapers, but as I can tell you when I lead these judges' trips to Israel, Israel is fighting an almost preposterously Jewish war, where all of the calls of strikes that are not emergent are made by lawyers in the field. This is a reality that must be understood. Israel has a corps of military advocate generals. They're called MAGs. Think about our JAGs, for example, and many of our judges were JAGs, and so the context and the contrast is stark. Military advocate generals are deployed in the field with the commanders all over Gaza and on the Gazan border, and one of the things that you should remember about the military advocate generals isn't just their deployment. It's also that their advice is not precatory. So in the United States, a JAG says to a commander, "You shouldn't strike. That's my advice." But the commander can always override the strike because the advice is precatory. In Israel, the MAG's advice is not precatory. It's mandatory. It's an order that must be followed. Of course, if the commander disagrees, there's a whole appellate mechanism that goes to senior commanders that ultimately could end up in front of an IDF judge. I mean, this is the ridiculously legalistic way in which these Jews fight these wars. And frankly, we have seen, as judges, dozens and dozens and dozens of videos where this plays out in real time. Videos, which somehow don't make it into The New York Times, where pilots are in their planes or flying their drones over clear Hamas targets— terrorists shooting out of a mosque or out of a hospital or out of a UN car. Yes, that happens in Gaza every single day. And the pilot says, "I'm ready to fire." And then something amazing happens, something our American JAG officers are like, "What is happening here?" A nerdy Jewish lawyer comes over the air, the airwave and says, "Hey, what's that 50 yards away on the top right of the screen? Scan over to the top right of the screen." And it's two children playing soccer or three women holding a loaf of bread having a conversation. And instantly it's "Strike canceled. Strike canceled. Strike canceled." Over and over again in Gaza and in Lebanon, legitimate strikes on legitimate military targets that almost any other Western army in the world would take are canceled by Israeli lawyers, international law scholars, because of a concern for the preservation of innocent Palestinian civilian life.

Hi, Kevin. International law prof + retired combat soldier/military lawyer U.S. Army here. I watched the show, too. If you're genuinely curious about the discrepancy between Bill Maher & some groups/agencies on the "genocide" issue, read on. You may not hear back from Bill, but I am glad to bring focus to the discrepancy between Bill's correct opinion & that of "some groups and agencies" that "are in disagreement." To start, let's recap what Bill said in case not everyone did see the show in question. This was an episode of Real Time with Bill Maher that aired HBO Max this past Friday (8/21). His guests for this segment were Dana Bash & The New York Times reporter Jeremy Peters. As you can see, Bill is talking about the current situation in Democrats party. On that subject, he says, "They think Gaza is a genocide. It is not. There's an actual meaning [for] the word 'genocide.' It doesn't come close." This discussion continues for another minute or so, and his guests Dana & Jeremy join in on occasion. What we don't see in this clip is an explanation for what you refer to as a discrepancy between Bill's view & that of "some groups & agencies" to which you refer. That's the point of the rest of this post - to fill in that gap that doesn't get addressed in Bill's commentary. The short answer for clarifying the discrepancy can be summarized in just 2 words: sources & methodology. Allow me to explain. Regarding sources, you need to be aware - if you're not already - that the primary source for establishing international law is ... nations. It's right there in the name: interNATIONal law - or law between nations. And this is probably so elementary it doesn't need to be said, but I'll say it anyway: "some groups & agencies" are not nation-states. At best, groups like Amnesty International & Human Rights Watch & International Association of Genocide Scholars (which prudently nuked its account after it released the ill-advised "resolution" referred to in the screenshot of what appears to be the Google AI search results you included with your post) qualify as subsidiary sources of international law. So, there isn't actually a "consensus" among such groups. The only people who claim otherwise are those who selectively highlight the groups that have claimed Israel ישראל is responsible for #genocide in #Gaza while ignoring the experts & groups who have determined otherwise. Even so, citing to findings of these groups - regardless of where they land on the genocide issue - represents a fundamental misunderstanding regarding how interNATIONal law is formed. If we stick to the primary source of international law - you know, actual nations - only about 1 in 3 United Nations Member States have publicly announced or concluded there is/was genocide in Gaza. Specifically, that's 64 out of 193 UN Member States that have made that determination. 129 have either announced their determination that there is NO genocide or they haven't taken a public stance on the issue (most of the latter are waiting for the final judgement in RSA v. Isr CIJ_ICJ, which likely won't be reached for several years). And how do we know that only 64 of 193 UN Member States have publicly announced a "genocide" determination? Easy. I counted. 64 represents the most generous tally I could possibly develop, and it is still only about 33% of UN Member States (pic 1, and it's a number I assess will reduce even more since I conducted the count about 2 months ago since many of these announcements were made for political reasons & domestic politics in several states have shifted from liberal to conservative since then). Ok, that's the full explanation for the first word in the short answer: sources. You're referring strictly to subsidiary sources as evidence of a "discrepancy" between Bill's view & that of "some groups & agencies." But if you refer to the primary source of international law, you'll notice there is no discrepancy at all. In fact, there is a "discrepancy" between states & this collection of "yes, genocide" groups & agencies to which you refer. And that brings us to the second word in the short answer: methodology. You see, the decisive element in determining whether a genocide has been committed typically involves intent. And assessing 🇮🇱 intent is where these "yes, genocide" groups & agencies go astray. Almost always, they correctly articulate the standard for genocidal intent. We can find that right there in the Genocide Convention. In case you're not aware, "genocide" involves committing specified acts "with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such" (pic 2). Now, here's the methodology these groups & agencies adopt without exception. They refer to a carefully-selected sampling of commentary from certain 🇮🇱elected officials - often mistranslated, misrepresented, or taken out of context - to establish what they claim to be intent to destroy Palestinians, as an identity group, in whole or in part, as such. For example, they point to a comment from יואב גלנט - Yoav Gallant on 9 Oct 2023 - just 2 days after the 10/7 terror attacks - saying Israel Defense Forces is fighting against "human animals." However, it's clear from the context that Gallant was referring to Hamas, not the Palestinian population as a whole. There's also a quote from Israel ישראלiPM Benjamin Netanyahu - בנימין נתניהו that is always cited in which he says, during remarks televised on 28 Oct 2023, "Remember what Amalek did to you." For those who aren't familiar, this is a reference to Deuteronomy 25:17–19, which says: "Remember what Amalek did to you on your journey, after you left Egypt — how, undeterred by fear of God, he surprised you on the march, when you were famished and weary, and cut down all the stragglers in your rear. Therefore, when the Eternal your God grants you safety from all your enemies around you, in the land that the Eternal your God is giving you as a hereditary portion, you shall blot out the memory of Amalek from under heaven. If you're genuinely curious about the discrepancy between Bill Maher & some groups/agencies on the "genocide" issue, read on. You may not hear back from Bill, but I am glad to bring focus to the discrepancy between Bill's correct opinion & that of "some groups and agencies" that "are in disagreement." To start, let's recap what Bill said in case not everyone did see the show in question. This was an episode of Real Time with Bill Maher that aired HBO Max this past Friday (8/21). His guests for this segment were Dana Bash & The New York Times reporter Jeremy Peters. As you can see, Bill is talking about the current situation in Democrats party. On that subject, he says, "They think Gaza is a genocide. It is not. There's an actual meaning [for] the word 'genocide.' It doesn't come close." This discussion continues for another minute or so, and his guests Dana & Jeremy join in on occasion. What we don't see in this clip is an explanation for what you refer to as a discrepancy between Bill's view & that of "some groups & agencies" to which you refer. That's the point of the rest of this post - to fill in that gap that doesn't get addressed in Bill's commentary. The short answer for clarifying the discrepancy can be summarized in just 2 words: sources & methodology. Allow me to explain. Regarding sources, you need to be aware - if you're not already - that the primary source for establishing international law is ... nations. It's right there in the name: interNATIONal law - or law between nations. And this is probably so elementary it doesn't need to be said, but I'll say it anyway: "some groups & agencies" are not nation-states. At best, groups like Amnesty International & Human Rights Watch & International Association of Genocide Scholars (which prudently nuked its account after it released the ill-advised "resolution" referred to in the screenshot of what appears to be the Google AI search results you included with your post) qualify as subsidiary sources of international law. So, there isn't actually a "consensus" among such groups. The only people who claim otherwise are those who selectively highlight the groups that have claimed Israel ישראל is responsible for #genocide in #Gaza while ignoring the experts & groups who have determined otherwise. Even so, citing to findings of these groups - regardless of where they land on the genocide issue - represents a fundamental misunderstanding regarding how interNATIONal law is formed. If we stick to the primary source of international law - you know, actual nations - only about 1 in 3 United Nations Member States have publicly announced or concluded there is/was genocide in Gaza. Specifically, that's 64 out of 193 UN Member States that have made that determination. 129 have either announced their determination that there is NO genocide or they haven't taken a public stance on the issue (most of the latter are waiting for the final judgement in RSA v. Isr CIJ_ICJ, which likely won't be reached for several years). And how do we know that only 64 of 193 UN Member States have publicly announced a "genocide" determination? Easy. I counted. 64 represents the most generous tally I could possibly develop, and it is still only about 33% of UN Member States (pic 1, and it's a number I assess will reduce even more since I conducted the count about 2 months ago since many of these announcements were made for political reasons & domestic politics in several states have shifted from liberal to conservative since then). Ok, that's the full explanation for the first word in the short answer: sources. You're referring strictly to subsidiary sources as evidence of a "discrepancy" between Bill's view & that of "some groups & agencies." But if you refer to the primary source of international law, you'll notice there is no discrepancy at all. In fact, there is a "discrepancy" between states & this collection of "yes, genocide" groups & agencies to which you refer. And that brings us to the second word in the short answer: methodology. You see, the decisive element in determining whether a genocide has been committed typically involves intent. And assessing 🇮🇱 intent is where these "yes, genocide" groups & agencies go astray. Almost always, they correctly articulate the standard for genocidal intent. We can find that right there in the Genocide Convention. In case you're not aware, "genocide" involves committing specified acts "with intent to destroy, in whole or in part, a national, ethnical, racial or religious group, as such" (pic 2). Now, here's the methodology these groups & agencies adopt without exception. They refer to a carefully-selected sampling of commentary from certain 🇮🇱elected officials - often mistranslated, misrepresented, or taken out of context - to establish what they claim to be intent to destroy Palestinians, as an identity group, in whole or in part, as such. For example, they point to a comment from יואב גלנט - Yoav Gallant on 9 Oct 2023 - just 2 days after the 10/7 terror attacks - saying Israel Defense Forces is fighting against "human animals." However, it's clear from the context that Gallant was referring to Hamas, not the Palestinian population as a whole. There's also a quote from Israel ישראלiPM Benjamin Netanyahu - בנימין נתניהו that is always cited in which he says, during remarks televised on 28 Oct 2023, "Remember what Amalek did to you." This will be the pair’s FIFTH meeting in the United States this year, but of course it would be antisemitic to suggest that there’s anything strange about the US president meeting with the Israeli prime minister more frequently than with any other foreign leader on the planet. NBC reports that Netanyahu is expected to discuss more attacks on Iran during the visit, citing concerns about “Iran’s efforts to rebuild facilities where they produce the ballistic missiles and to repair its crippled air defense systems.” Which is just wild. They’ve stopped making up pretend nonsense about nuclear weapons and now they’re just going “We need to attack Iran because Iran is rebuilding its ability to stop us from attacking it.” ❖ On Christmas Day, Donald Trump became the first American president ever to bomb Nigeria. While Trump claimed the Tomahawk missile strike was directed at ISIS targets with the goal of protecting Christians in the northwestern farming community of Jabo, locals told CNN that Islamic State has had no presence in the area and that Christians and Muslims coexist peacefully there. Residents also told Al Jazeera that the airstrikes resulted in no casualties, civilian or otherwise, meaning the bombing accomplished nothing besides terrifying some farmers and setting a precedent to normalize US airstrikes in yet another African nation. ❖ Israel has ignited worldwide controversy by formally recognizing the breakaway Somali region known as Somaliland. I’ve seen a lot of people highlighting reports that Israel has been in communication with Somaliland as a potential location to which the population of Gaza might be deported in an ethnic cleansing operation of the Palestinian territory, noting that recognition could be a way of enticing Somaliland to agree to the arrangement. Back in August the Times of Israel reported that “Israel is in talks with five countries or territories — Indonesia, Somaliland, Uganda, South Sudan and Libya — about potentially accepting resettled Palestinians from the Gaza Strip,” adding that “Somaliland is a breakaway region of Somalia that is reportedly hoping to secure international recognition through the deal.” ❖ A German journalist named Anna Liedtke reports that she was raped by Israeli forces after she was abducted from the Global Sumud Flotilla while attempting to deliver aid to starving people in Gaza this past October. Unsurprisingly, as of this writing there appears to be a near-total media blackout on Liedtke’s story in the German press. ❖ Activist Greta Thunberg has been arrested by British police because in the UK it is considered an act of terrorism to hold a sign which says “I support the Palestine Action prisoners. I oppose genocide.” Zionism is the single greatest threat to free speech in the western world. ❖ New South Wales Premier Chris Minns defended his authoritarian crackdown on pro-Palestine protesters following the Bondi shooting by arguing that Australia doesn’t have the same free speech protections as the US. “I acknowledge that we don’t have the same free speech rules that they have in the United States and I make no apologies for that, we have got a responsibility to knit together our community,” Minns said. And of course Minns isn’t wrong when he says Australians don’t have any real free speech rights (Australia is the only western democracy without any kind of national bill of rights), but it is a bit odd to be openly proclaiming that this is a good thing because it means you’re allowed to stomp out criticism of Israel. Kinda feels like that’s saying the quiet part out loud. It’s been so surreal watching in real time as Australians get manipulated into accepting the Zionist narrative about the Bondi Beach attack. Some of it is arising from organic American racism and the knee-jerk rightist impulse to throw anyone to the left of Bill Clinton out of a flying helicopter, but a lot of it has nothing to do with Mamdani at all. The election of a Muslim to the most high-profile mayoral position in the United States provides Israel supporters with ample opportunity to stir up panic about Muslims in America on the assumption that Israel will benefit from such sentiments, since Israel is always killing Muslims. There is no argument to be made that Israel is a good nation that is inherently deserving of support, so they’re banking on circulating the belief that it’s good to drop bombs on Muslims instead.
