We attended court for the arraignment of hundreds of Kenyans who were arrested during yesterday's demonstrations in Nairobi. We secured the release of more than 200 youth charged with obstruction of motor vehicles on cash bail of a Kshs. 1000, and the unconditional release of a mother with a 7 month old baby. We thank the Court for upholding the rights of all who were arrested for expressing themselves in accordance with the law. We turn to the ODPP in hope that all these charges will be dropped. Our team of Advocates has been unable to gain access to Kasarani Police Station, where some Kenyans are being held, as the roads have been barricaded. We take note of reports of several persons who have been beaten up and injured by police. We demand that the National Police Service-Kenya exercise restraint from using excessive force against the people. We have also seen images of police indiscriminately lobbing teargas cannisters in largely residential areas and without provocation. This itself is a breach of the peace and order police are required to maintain.

We condemn the heinous attack on Governor James Orengo in Migori during an engagement with the people today. What started with senseless interruption of a peaceful meeting by police officers culminated in a brazen attack by thugs who torched one of the cars in the entourage and sprayed it with bullets. This level of violence is not only unacceptable, it is a precursor to a state of insecurity that the government will be unable to contain if it is left unchecked. Democratic freedoms and the expression thereof cannot be used as an excuse to weaponize organised crime against people of different political persuasion. I am deeply saddened by the reports of yet another fire ravaging stalls at Gikomba Market this morning, leaving traders counting losses as their goods go up in flames. My heart goes out to every hardworking Kenyan whose livelihood has been wiped out overnight. No family should have to repeatedly rebuild from ashes while questions about safety, accountability and lasting solutions remain unanswered. Leaders and relevant agencies must move beyond promises to concrete action. We must pursue proper market planning, real fire safety infrastructure and transparent investigations into these recurring infernos that keep targeting one of Nairobi’s most important economic hubs. Today, we stand in solidarity with Gikomba traders and commit to amplifying their cry for justice, compensation and meaningful reform so that never again finally means something.

Rape, defilement, sodomy and domestic violence are not disputes but crimes. You do not negotiate trauma. You prosecute it. AJS has its place in our justice system, for commercial disputes, neighbourhood conflicts, restorative processes where parties bargain from relatively equal power. But in sexual and gender‑based violence, the power imbalance is structural and brutal. The law cannot tell a survivor to sit across the table from their abuser and bargain away accountability. We have seen the damage when sexual offences are pushed into informal settlements. Silence, intimidation, family agreements that erase the survivor and entrench impunity. Communities are pressured to protect the perpetrator’s name, not the survivor’s future. When the court abdicates to such processes, it abandons its constitutional duty to protect the vulnerable. Saying no AJS for sexual offences is, therefore, a line in the sand. Some harms are so grave that the State must speak, investigate, and prosecute loudly and clearly. We are dealing with a procurement system of violence with well known politicians as the buyers while the unemployed Kenyans are the commodity trading impunity as their currency!
