In the latest Federal Court decision in the ongoing Giggle case, the court upheld that “gender identity” protections under anti-discrimination law can override single-sex spaces. Even those created exclusively for women. The law is drifting away from biological sex as a protected category, and in doing so, is stripping away the legal certainty women once had around female-only spaces and services. If sex no longer has clear legal meaning, then women’s boundaries in law are no longer fixed. They’re negotiable.
