Retired Massachusetts judge tells me; Keep your eyes on a possible next step in the Lindsay Clancy case: a “Fidler hearing.” After a mistrial in the triple murder case, Clancy’s defense is again asking the judge to find her not guilty as jurors reveal what happened behind closed doors. “If a juror truly had reasonable doubt about criminal responsibility, the law required a not-guilty verdict,” retired Massachusetts Judge James Barretto explains. But the holdout “could have misunderstood—or worse, even misapplied—the law.” Barretto says credible evidence of juror misconduct, bias or dishonesty during jury selection could trigger a Fidler hearing—an evidentiary hearing examining what happened and whether it affected the trial. Listen to Barretto explain the legal roadblock—and what could trigger a rare Fidler hearing—on my show NewsNation Live.

EXCLUSIVE: Scene of Nancy Guthrie private lab testing. I’m outside DNA Labs International where the DNA Testing of evidence is happening right now. I traveled to Deerfield Beach, Florida where lab technicians have been testing critical evidence in the investigation — including the glove found nearly 2 miles from her home. We’ve heard a lot about the discrepancies of sending this type of DNA evidence to a private lab versus a lab used by the FBI, but the Pima County Sheriff, Chris Nanos, says this is their protocol, and a lab that they have used for years. There are only a limited number of private accredited DNA labs in the country capable of this level of forensic work. If possible, DNA Labs International will develop a DNA profile from the glove. According to independent DNA consultant Suzanna Ryan of Ryan Forensic, which is not connected to this case but can speak about how this all works, once a profile is developed it will most likely be sent to the Arizona Department of Public Safety. That’s where the quality control process begins: •A qualified DNA analyst or CODIS administrator verifies the data •The profile must meet strict standards before upload •Once approved, it is electronically transmitted through state systems to the Federal Bureau of Investigation •All systems work together within the national DNA database network CODIS This extra verification step can take time — but it’s critical to ensure the data is admissible and accurate. In this exclusive video, I take you to the scene of where this testing is being done. Because the lab sits on private property, we were asked to leave by property management — but this is where the forensic work is happening. VERDICT WATCH DAY 3: PRESS SCRUM Lindsay Clancy’s defense attorney Kevin Reddington stepped out to grab coffee and answered questions from a waiting press pool. Earlier in the day, Reddington made it clear he was angry about some television commentators discussing his client and the case over the weekend. I asked him about that criticism, as well as who is here supporting Lindsay Clancy as the jury continues deliberating. Then, in the middle of our questions, two women who said they drove all the way from Houston, Texas, approached Reddington to thank him for his defense of Clancy. They shared their own families’ experiences with postpartum depression and told him they wished they had someone like him advocating for them during that difficult time. WATCH the full courthouse scrum and hear what Kevin Reddington — and the women who traveled from Texas — had to say. #LindsayClancy #LindsayClancyTrial #VerdictWatch #KevinReddington #TrueCrime #CourtTV #PlymouthMassachusetts #PostpartumDepression

🚨BODY LANGUAGE ANALYSIS🚨 I spoke with leading body language and deception expert Susan Constantine on NewsNation Live about what she sees in the Nancy Guthrie case — and her observations are fascinating. From the shape of the eyes of the masked man captured on the doorbell camera… to the subtle identifiers visible in those brief seconds of footage… Susan breaks down: ▪️ Eye structure and spacing ▪️ Brow tension and muscular movement ▪️ Facial recognition markers ▪️ What can — and cannot — be determined from limited video ▪️ Behavioral cues during the SWAT operation When you only have seconds of video, every micro-detail matters. Are those eyes enough to narrow down a suspect? Can facial identifiers still be analyzed even with a mask? We walk through it all. What does the prosecutor who convicted Susan Smith think about the Lindsay Clancy trial? I asked him to break down one of the most difficult cases he’s seen since 1995 on NewsNation Live this weekend during my Sunday show on NewsNation The Lindsay Clancy murder trial resumes today as jurors continue hearing evidence in one of the nation’s most closely watched criminal cases. Tommy Pope was the lead prosecutor in the 1995 Susan Smith case. While the facts of the two cases are different, both involve mothers accused of killing their children, making Pope’s insight especially compelling. We discuss the emotional challenges for jurors, the postpartum psychosis defense, and what to watch for as the trial moves forward, and what he makes of the field trip jurors took last week to the crime scene. The house where prosecutor say it all happened.

#JonBenetRamsey case update ⬇️ Netflix has released “Cold Case: Who Killed JonBenét Ramsey,” a three-part docuseries exploring the haunting 28-year-old mystery. This week I spoke one on one with her father John Ramsey while guest hosting Banfield - we discussed the frustrating journey to justice and why the Colorado Police Department has not invited independent investigative genetic genealogy labs to help solve the case … yet. I asked John Ramsey about his recent conversations with a new investigator about why they haven’t taken up ’s offer to help. He said “Well, we did. And basically what he said, Okay, look, there's some things happening that I can't tell you about, and don't think DNA technology is there yet. I totally disagree with that. I met the founders of Othram Labs, which is one of the cutting edge labs out there that'd be happy to help. I sent a letter to the chief based on my meeting with what I learned with Othram they said A) they don't destroy any DNA when they do testing on it anymore, which was one of the concerns. B) they have the ability to separate DNA, mixed DNA samples, which is one of the issues with the sample they got in 1997 they had an unidentified male DNA sample in early 1997 it was mixed, apparently, with the blood DNA that can, now technology wise, be separated. That's huge. And the third thing, they have the ability to do familial genealogy research, which has been wildly successful in solving Old, old cold cases. That's what we're asking the police to do. Go to one of these cutting edge labs, let them do new testing, and they need a new DNA sample. We have a DNA sample which was obtained in January 1997 of an unidentified male DNA. It's not in the format needed to do this familial genealogy research to be a new command, and that's why we need to do more testing.
