This settlement — and the litigation that led to it — was effectively a backdoor effort by the government to mandate age verification. It succeeded. Now Meta is pressuring TikTok and YouTube to voluntarily adopt the same requirements and restrictions found in its settlement. It’s hard to know whether that pressure stems from genuine concern for kids or Meta’s own bottom line. Some of the restrictions it agreed to could put it at a competitive disadvantage unless its rivals follow suit. Nevertheless, few people are talking about the free speech and privacy implications of the settlement — including for adults, who are on the fast track to having to verify their identity before accessing vast swaths of the internet, including this website. It just so happens that earlier this week I hosted a So to Speak: The Free Speech Podcast debate on this very topic, where we also touched on the AG’s lawsuit against Meta:

Yes, FIRE spent a lot of time defending conservatives on campus these past 10 years. But the enemy of free speech isn’t necessarily partisanship, it’s power. And in recent months, the boot has been on the other foot. I list the threats w/ Mehdi Hasan for Zeteo:

If you think speech bans will stop with your enemies, history suggests otherwise. Here's one example: In 1974, the National Union of Students in the United Kingdom adopted a policy banning racist and fascist speakers. The Union of Jewish students supported the policy, thinking it would apply to the right-wing National Front. A few years later, the Jewish student group watched as some local unions used the policy to ban Zionist speakers on campus. As former ACLU Executive Director Ira Glasser once said, speech restrictions are like poison gas — they may seem like a powerful weapon when the enemy is in your sights and the wind is at your back. But the wind has a way of shifting. And when it does, you will want the right to offend firmly on your side. My closing remarks at the The Cambridge Union debate: "This House Believes In The Right To Offend."

What's good for the goose is good for the gander. The tactics we use against our opponents today will be used against us when power changes hands. I'll shout it from the rooftops. I'll shout it on CNN. I'll shout it into the void if nobody will listen — because it's true.

Long ago, America broke with the United Kingdom's censorial practices. Now it's time for the UK to make a break with itself. It's time for the country to embrace freedom of speech and the right to offend. My remarks at Cambridge on this very topic:

Here is a former ACLU leader explaining that exercising your Second Amendment rights should not limit your First Amendment rights. He made these statements amidst the debate over the carrying of weapons during the protest in Charlottesville. Sitting next to him is former ACLU Executive Director Ira Glasser, who has made similar arguments. Norman Siegel: "Well, what about when we represented the Black Panthers and they would stand there with their guns back in the 60s? What about the Defense of Justice team in Mississippi and Louisiana back in the 60s who had guns all the time on them and had them as a deterrent to the people in the Deep South. You can’t have a double standard." The clip is from my film "Mighty Ira" (2020). The segment about weapons at protests begins ~1:21:55.

How FIRE defends free speech: "The precedents stay where they are. The facts change, the viewpoints change, the threats to free speech [and] the directions they come from change, but the principles have to remain the same. That’s what we are trying to do here at FIRE." -Will Creeley

It’s long past time we scrap the “Bizarro World” content regulations for broadcast TV and radio. They offend the First Amendment, invite government weaponization, and make no sense in an era of podcasts, cable, and social media. via Jake Tapper 🦅 and The Lead CNN

Does the UK need a First Amendment? I recently debated the question in London at Academy of Ideas. My argument? Legal protections for free speech are important, but they are not enough. My evidence? The history of the First Amendment.
