The debt question Kenyans must ask is simple: Why does the debt keep growing every year despite billions already being paid? How do we borrow, repay, borrow again, and still sink deeper into debt? This is why the conversation on odious debt can no longer be avoided. One dangerous issue that must be addressed is the amendment to the Public Finance Management Act, which allowed the National Treasury to borrow outside the Consolidated Fund framework. Public borrowing must remain transparent, accountable, and subject to full constitutional oversight. Kenyans deserve to know: Who borrowed? How much? For what purpose? Who benefited? And why are ordinary citizens carrying the burden while public services continue to collapse? An MCA’s primary role as clearly defined under Article 185 of the Constitution of Kenya 2010 and Section 9 of the County Governments Act 2012 is to legislate, represent the people, and provide oversight in the ward. Actual development funds and project implementation rest with the County Executive, per the separation of powers in the Constitution and the County Governments Act. I am deeply disturbed and outraged by this video from Busia County Referral Hospital. If it is true that the hospital has detained these young mothers and their newborns as alleged simply because they cannot pay cash for maternal services then it is illegal, unconstitutional and inhumane. This amounts to unlawful confinement and a gross violation of the dignity of our mothers. The following county officials MUST urgently investigate this matter and act immediately: • H.E. Dr. Paul Nyongesa Otuoma, Governor of Busia County • The County Executive Committee Member for Health & Sanitation, H.E Hon. Yesterday in the Senate, I also submitted a Statement seeking answers on an unexplained withdrawal of KSH 19.7 BILLION from the consolidated fund in January 2025, under the vote item “State Officers’ Salaries, Allowances and Miscellaneous.” The budget for that entire item was KSH 4.2 BILLION for the whole year, yet over KSH 19 BILLION was moved in a single month. This figure far exceeds the monthly average of 287 MILLION, and no lawful justification has been provided. I’ve demanded full disclosure of who received the funds, who approved the excess withdrawal, whether due process was followed under the Constitution and Public Finance Management Act and what corrective action has been taken.
