Caller: “My mother is 85 years old and she owes debts on her credit card worth $45,000 Who is liable for her unpaid credit card debt?” Dave Ramsey: “Only she is” Jade Warshaw: “unless you’re a co-signer.” Caller: “She accumulated the $45,000 across five different credit cards. They approved her for the cards at high interest rates even though Social Security is her only income. I haven’t even tried reaching out to the credit card companies.” Dave Ramsey: “I wouldn’t worry about that. She doesn’t have any money to give them anyway.” “I would explain to her that if she ever borrows money again, knowing she has no ability to repay it, that would be stealing. She has to stop borrowing not just for financial reasons, but on a moral basis.” “If someone dies with no assets, their debts generally go unpaid they aren’t passed on to family members. If there are assets, they’re used to pay debts before any inheritance is distributed. Since she owns nothing and her only income is Social Security, there’s nothing for creditors to collect, and Social Security benefits generally can’t be garnished. In her situation, she’s considered judgment-proof.” “I’m under no moral obligation to these companies. They chose to lend money to an 85 year old widow whose only income is Social Security. They took that risk so they are getting nothing”
